Recently, it was revealed that Apple may have been intentionally causing phones to slow down with new features in its more recent operating system updates.

As a result, Apple is facing quite a few lawsuits citing purposeful iPhone slow down tactics by the technology giant.

One such iPhone slow down lawsuit has been filed by plaintiff Victor M. Victor, a resident of Queens, N.Y., claims he purchased an iPhone 6s Plus in March 2016. He says that as soon as he updated his operating system to iOS 10, he began experiencing problems with his new phone. Victor says as he continued to install updates to his phone, he experienced more and more iPhone slow down problems.

According to the iPhone slow down lawsuit, “Apple has been intentionally limiting older iPhone performance in certain circumstances through its iOS updates.”

Even though updating the operating system is entirely optional, over time, if a user did not update the iOS, the phone would fail to run important applications that the user relies on, thereby making the phone unable to work properly.

Victor asserts that by concealing the slow down, Apple led customers like himself to believe that they needed to buy a new phone. He alleges that Apple should have informed customers in a timely manner that a new battery would help with iPhone slow down problems. But instead, they allegedly kept their practice of “throttling iPhone performance” concealed.

Victor alleges that he experienced the following iPhone slow down problems: slow operating speed, reduced battery life, slow service while using applications, screen freezes, freezing applications, rapid decline in battery power, and sudden and random iPhone shutdown or restart.

Victor asserts that Apple advised him to trade in his phone for a refurbished phone. He did so and paid the necessary fees, but the iPhone slow down problems continued. He claims that Apple interfered with the normal and ordinary use of his phone.

In October 2017, Victor preordered the iPhone X and received it on Nov. 8, 2017. He opted for this model rather than the iPhone 8 because he believed it was the “top iPhone model.” Victor paid around $1,000 for the newest iPhone and was unaware that had he simply not updated his original phone, he would not have experienced these iPhone slow down problems.

Victor asserts that Apple “secretly slowed down the speed of older iPhones with degraded batteries through iOS 10 and 11 updates” and “engaged in deliberate CPU throttling of older iPhones with degraded batteries.” He claims they did so without giving users the opportunity to make informed decisions. Victor is proposing class-action status for his iPhone slow down lawsuit.

This iPhone Slow Down Lawsuit is Case No. 1:18-cv-00051 in the United States District Court for the Eastern District of New York.

    I had a I phone 7 and it kept on shutting down and drooping the calls the phone has never been damaged i also added a booster for my apartment because that is what i was told via my phone carrier when i contact the apple support team i was told because of the new phones coming out and the different version of phone operating systems my phone would not support the newsiest version there fore that is why i stared receiving slow down and dropped calls etc bottom line i was told i had no choose but to upgrade my phone which is $700. something please advise if i am eligible to be part of this action suite

    I have 4 phones mine and my 3 children’s. That did all of these things. Took them to the store and they claimed they was nothing wrong except it was the sims card and I had to buy new sims cards still had problems so we finally bought new phones upgraded to the 6s & 7 still same issues but worse now. This is a lot of money for a single mom of 3.
