24 hour fitness class action

Members who paid annual renewal fees for a 24 Hour Fitness membership may qualify for refunds and lower fees, thanks to a class action settlement.

The settlement resolves allegations that 24 Hour Fitness offered members lifetime renewals for an annual fee that would not change, then later raised that fee on some members.

The plaintiffs claim that 24 Hour Fitness USA Inc. offered a membership plan in which, if the member prepaid one to three years’ worth of membership, they could maintain the membership indefinitely by paying the same annual renewal fee every year.

These annual fees were allegedly supposed to remain the same for the rest of the member’s life, as long as they wanted to remain a member.

But with a change in ownership, the plaintiffs say, 24 Hour Fitness began to alert members that it would raise their annual renewal fees, in some cases to as much as double or triple the previous rates.

Fine print in the membership agreement supposedly allowed 24 Hour Fitness to raise the fee. But the plaintiffs say the company promised them that the agreements were “just paperwork” and didn’t matter, and that 24 Hour Fitness would never increase the fees.

This settlement results from two consolidated lawsuits. Plaintiffs Kevin O’Shea, Mark Vitcov, Rod Morris filed their 24 Hour Fitness class action lawsuit in April 2016. They were followed one month later by plaintiff Russell Marchewka, who claimed his renewal fees would nearly double. The claims were consolidated into a single action and joined by additional plaintiffs Michael Losquadro and Dipti Shah.

24 Hour Fitness maintains that nothing about the way it administered these fees was wrong. The company says it agreed to this settlement to avoid the risk and expense of further litigation.

The parties reached the current 24 Hour Fitness settlement and submitted it for preliminary court approval by November 2017. The settlement provides different benefits depending on whether the Class Member submits a Claim Form.

Those who do submit a Claim Form are generally eligible to continue their 24 Hour Fitness membership by continuing to pay their original fee amount. Those who do not submit a form will benefit from limitations on how 24 Hour Fitness may increase their annual renewal fees.

Claim Forms may be submitted online or by mail. Printed Claim Forms were supplied with the settlement notice mailed to known Class Members.

The Claim Form and declaration for this settlement also applies to another settlement brought by the Orange County and Contra Costa County’s District Attorney’s offices, referenced in the settlement website as the Government Settlement. Both settlements require Class Members to submit a Claim Form and declaration by the Feb. 26 deadline.

Class Members can object to the settlement or exclude themselves from it by submitting a written request no later than Feb. 26, 2018.

Who’s Eligible

The settlement Class covers persons who, according to 24 Hour Fitness’s records, enrolled in or updated a 24 Hour Fitness Prepaid Membership on or after April 1, 2006 and were still enrolled in a prepaid membership as of April 1, 2015.

The available benefits are very detailed, depending on the individual Class Member’s situation. Consult the settlement website for full details.

Generally, Class Members who submit a Claim Form will be allowed to continue their memberships by paying the annual renewal fee at its initial amount, whether or not their fees have been increased. Those whose fee has increased may get the fee reinstated at its initial amount and may receive a refund for any fee amounts they paid over and above the initial fee amount. Those whose memberships were cancelled after they received notice of a fee increase can get their memberships reinstated at the original fee amount.

Class Members who do not submit a claim form may see their annual renewal fees increased, but 24 Hour Fitness will be restricted in when and how much it can raise those fees. The restrictions vary depending on the type of membership. Those whose fees have already increased may receive a discount on future fees. Those whose memberships were cancelled may be able to reinstate them at a reduced amount.

Proof of Purchase

To submit a Claim Form and declaration online, Class Members must provide either the claimant ID number provided in their settlement notice or their prepaid membership agreement number.

    I, too just recieved an email that my lifetime membership dues that has been $49 a year foe almost 15 years has been increased to $94.

    Same. Contract enforcability sure isn’t like it used to be. Try getting a human on the phone to advise you at the Calif AG’s office or consumer affairs… voice menus lead you to oblivion after wasting 10 minutes of your time.

    I have been a member of 24-Hour Fitness since 1988 and signed up for the initial payment of $650 and guaranteed annual payments of $49 for life. I was told that a form was sent to my residence in 2017, and because I did not reply, my annual payment has doubled. I feel hurt because I have kept to my part of the agreement since 1988. I never heard of the original case action lawsuit and did not hear about the settlement in 2016 or thereabouts. This does not seem right.

      Same here. I was a member since 2008 and guaranteed a $99 for life. They increased the fee once $149 3 years ago. Then this year, they decided to increase it to $234 which is more than 60% compare to last year and 200% compare to the original amount I signed. This is not right.

      I remembered I was part of the class action lawsuit and received no notification of the settlement

    In the same boat! I was never notified of a previous class action lawsuit. Neither by email or mail. I’ve been a prepaid lifetime member since 2007. I paid $650 upfront and was promised $49/year for life. Two weeks ago I received notice that they would raise my rate from $49/year to $94/year. I think we need to begin a new class action lawsuit.

      I couldn’t agree more! I just learned my membership more than tripled annually and also had the $49 annual fee. After finally reaching a live customer service agent I was told there is nothing I can do. It sounds like another lawsuit.

    Same situation here. Noticed that my annual dues doubled. I asked my club about it and was told that I had not submitted a claim by the 2018 deadline. Unfortunately, I also don’t recall receiving any emails. From my understanding of class action settlements, once the deadline has passed, the liable party (24 Hour Fitness) is no longer open for further claims/lawsuits. Those we did not submit a claim are presumed to agree with the terms and waive further rights to sue 24 Hour Fitness. I suppose, theoretically if enough people had this issue, we could file another class action lawsuit about the fact that we weren’t notified.

      24 hr did not send me any notification email or by my address and have again increased please put me down for another class action

      I’ll join the lawsuit as it seems we are all in the same boat but paying different annual fees now. Are they pulling the figure from the sky? The 24 I signed up with was in San Diego County (Oceanside) signed for $899.88 March 2007 with a lifetime annual fee of $49 which is now trippled to $139.

        I think we should file another lawsuit. I swear that I haven’t received any mail or email from them. I go to the same one and live in the same address.

    Hello,
    I’m just learning about this now and I’ve been a member since 2006. I was never notified by either party in regard to a class action suit.
    This seems pretty unfair that I missed this opportunity and now my annual fee goes up l, nearly doubling.
    Is there anything that can be done at this point?

      I was part of the class action which I remembered to sign up for after they increased my fee from a guaranteed lifetime of $99 to $149. I can attest that I received nothing from them. Neither mail nor email. This whole thing seems shady and need another lawsuit

    annual increase and can`t get it resolved my membership was on 2003 and should have stayed at 49$ per year but it is now 139$
