Monsanto Company is facing a new Roundup cancer lawsuit, from an Arizona couple alleging a link between chronic lymphocytic leukemia and Roundup caused the husband to develop the deadly disease.
Plaintiffs David H. and Consuelo H. claim that Monsanto Company either knew or should have known about the alleged correlation between chronic lymphocytic leukemia and Roundup, but failed to warn the public.
According to the Roundup lawsuit, David had been exposed to the weedkiller on a regular basis between 1994 through 2016 and claims the company’s fraudulent actions concealed the risk of chronic lymphocytic leukemia and Roundup.
After regular exposure to Roundup, the couple alleges, David was eventually diagnosed with chronic lymphocytic leukemia in December 2015. The couple opted to file legal action soon after discovering chronic lymphocytic leukemia and Rounup may be linked, after the International Agency for Research on Cancer (IARC) released its formal evaluation of glyphosate in July 2015.
Glyphosate is the main ingredient used in Roundup, and was declared a possible human carcinogen along with certain other pesticides noted by the IARC.
Overview of Roundup Cancer Correlation
The IARC report presented an analysis of several different studies observing the effects of glyphosate, each of which concluded the weedkiller could cause cancer:
- Canadian Study: Starting in 2001, Canadian researchers observed the effects of glyphosate in farmers for a little over 10 years. This study was published by the American Association for Cancer Research, which found that non Hodgkin’s lymphoma could develop in subjects in under 10 years after exposure.
- United States Study: Published in the Occupational and Environmental Medicine journal, researchers concluded glyphosate and other pesticides were “potentially carcinogenic” and were “associated with increased non Hodgkin’s lymphoma incidence.”
- Swedish Study: Published in the International Journal of Cancer in October 2008, researchers found the risk of non Hodgkin’s lymphoma development nearly doubled in subjects in less than 10 years of glyphosate exposure.
Even though the IARC report was recently published, the Environmental Protection Agency (EPA) suspected there was a link back in the 1980s. Researchers began investigating this alleged correlation after noticing a significant number of farmers were diagnosed with non-Hodgkin’s lymphoma.
Monsanto Company allegedly knew about the dangerous association between their product and cancer development for years. The Roundup lawsuit alleges there was not a way for David or Conseulo to know about the alleged link between chronic lymphocytic leukemia and Roundup before this assessment was released.
Furthermore, the couple claims there was no language on the product indicating a link, nor did Monsanto Company make any effort to disclose the chronic lymphocytic leukemia and Roundup association. At all times relevant, David says he used Roundup for its intended purpose and did not deviate from product instructions.
David states he would not have used the weedkiller if he had known the alleged link between chronic lymphocytic leukemia and Roundup. David and Conseulo are raising multiple claims including negligence and loss of consortium.
This Roundup Lawsuit is Case No. 2:17-cv-04464-DLR, in the U.S. District Court for the District of Arizona.
