disability protectionPlaintiff Cindy B. has filed a lawsuit against Unum Life Insurance Company of America alleging that the company failed to pay her long-term disability benefits.

The Unum LTD benefits lawsuit maintains that Cindy is a resident of the state of California where she was employed as the Chief Operations Officer at Pyramid Peak Corporation.

As an employee of the company she had become insured in the company’s disability insurance plan, provided by Unum. She was provided, according to the Unum LTD benefits lawsuit, long-disability benefits through Pyramid Peak.

The definition of a “totally disabled” individual, according to the Unum policy and described in the disability benefits lawsuit, is when under “sickness or injury, you are unable to perform with reasonable continuity the substantial and material acts necessary to pursue your usual occupation in the usual and customary way.”

According to the Unum LTD benefits lawsuit, Cindy was diagnosed with multiple myeloma and secondary AL amyloidosis in April 2014. The medical reports claim that she had a mass of cancerous cells on her right pelvis. It is there where she had radiation treatment. She also underwent oral and intravenous chemotherapy and achieved partial remission.

The Unum LTD benefits lawsuit alleges that Cindy became disabled and is entitled to the benefits under her long-term disability plan because she suffers from chronic fatigue and cognitive deficits after going through life-saving chemotherapy to treat her multiple myeloma.

Unum found she met the definition of a totally disabled person in December 2014 and began paying her long-term disability benefits.

The Unum LTD benefits lawsuit maintains that after treatment she began working for Pyramid a few hours per week from home. It was there, however, that she was unusually tired, having difficulty focusing on problems, and forgetful. She had also become, “easily distracted, lost her train of thought frequently, and was making frequent mistakes in her work.”

Throughout 2016, Cindy had a compromised immune system. She had contracted four bacterial infections and had caught pneumonia which lasted for six weeks.

Unum Disability Denial of Benefits

In November 2016, Unum terminated Cindy’s long-term disability benefits. This is despite the fact that she still met the definition of a totally disabled individual under the plan, she claims. She not only received a neuropsychological report which had confirmed her cognitive deficits, according to the Unum LTD benefits lawsuit, but had also submitted updated medical reports and statements for her treating oncologist.

Unum still confirmed her termination of long-term disability in September 2017.

Cindy files the following causes of action against Unum which include recovery of LTD benefits and recovery of Life Insurance Premium Waiver Benefits.

Several allegations and lawsuits have been filed against the insurance giant by employees claiming that Unum systematically and purposefully deny consumer benefits, even after having paid for their policy.

Unum Life is the largest disability insurance company in the country, providing disability insurance to more than 17 million Americans.

The Unum LTD Benefits Lawsuit is Case No. 8:17-cv-01941, in the U.S. District Court for the Central District of California.
