Sterling Infosystems, EOTech Settlement Checks In the Mail

Top Class Actions viewers are starting to receive settlement checks from Sterling Infosystems FCRA class action and a class action that alleged EOTech falsely advertised its holographic weapons sights.

According to comments and posts on the Top Class Actions Facebook page, Class Members who submitted valid claims for the Sterling Infosystems class action settlement began receiving checks worth as much as $91.87 on Sept. 19, 2017.

EOTech Class Members who submitted valid and timely claims say they started receiving checks worth as much as $50 starting on Sept. 18, 2017.

The settlement agreement in the Sterling Infosystems class action lawsuit put to rest allegations that the company violated the Fair Credit Reporting Act when it failed to provide employment seekers with copies of criminal background checks they obtained during the hiring process.

The class action further alleged that Sterling failed to provide copies of background checks to applicants and employees before taking adverse actions against them and also failed to obtain complete criminal and traffic records.

Sterling denied the allegations, but agreed to pay between $20 and $85 to Class Members to avoid the cost of further litigation. Two Classes were identified in the settlement agreement. The Virginia Opt-In Class included “All natural persons (i) who were the subject of a consumer report sold by Sterling on any platform of Sterling except ESIQ to a third party from February 15, 2010 through October 31, 2016, (ii) who had a primary residential address in the Commonwealth of Virginia that was provided to Sterling in requesting such report, (iii) whose consumer reports contained at least one criminal record, (iv) who affirmatively opt in and complete a claim form certifying that their consumer report(s) was/were incomplete or not up to date, and (v) where no notice was sent under 15 U.S.C. § 1681k(a)(1).”

The second Class in the Sterling FCRA class action settlement was the Automatic Payment Class and included “All natural persons residing in the United States (including all territories and other political subdivisions of the United States) (i) who were the subject of a consumer report sold by Sterling on any platform of Sterling to a third party from January 29, 2013 through October 31, 2016, (ii) whose report contained a criminal record, (iii) who then directly or indirectly disputed such criminal record contained in their consumer report with Sterling, and (iv) whose dispute resulted in an amendment to the criminal record of their report.”

The plaintiffs in the Sterling FCRA class action lawsuit are represented by Consumer Litigation Associates PC.

The EOTech class action settlement resolved claims that certain holographic weapons sights made by the company between Jan. 1, 2005 and Nov. 1, 2016 were defective and did not perform as advertised. The class action plaintiffs alleged that the performance of the holographic weapons sights was affected under certain conditions and, as a result, the EOTech sites were not as durable or reliable as advertised.

The Class in the EOTech class action lawsuit includes U.S. residents who currently own certain EOTech holographic weapons sights models made between Jan. 1, 2005 and Nov. 1, 2016 and which were purchased on or before Feb. 15, 2017.

Additionally, Class Members also include those who previously received a refund from EOTech for one of the following HWS models; 400, 502, 511, 512, 512 CAMO, 512.XBOW, 512.LBC1, 516, 517, 518, 551, 552, 552.XR, 552.LBC1, 552.LBC2, 553, 555, 555.USMC, 556, 557, 557.4XFTS, 557.4XFXD, 557.3X.FTS, 557.G23.FTS, 558, EXPS2, EXPS3, HHS I, HHS II, MPO II, MPO III, XPS2, XPS2-RF, XPS2-Z, XPS2-Z2, XPS2-300, and XPS3.

The potential settlement award in the EOTech class action varies and depends on whether the Class Member received a refund or not. Those who received a refund received a $22.50 voucher for another EOTech product. Other Class Members who did not return their product for a refund received either $25 to $50 in cash or a $100 voucher for an EOTech product. Class Members who have yet to receive a refund could return their EOTech product for a refund ranging from $299 to $1,179 depending on the MSRP, plus $15 for shipping and a voucher for $22.50.
