Top Class Actions viewers are starting to receive checks in the mail from a class action settlement that accused Symantec Corp. and Digital River Inc. of misrepresenting some of their Norton products.
According to comments and posts on the Top Class Actions Facebook page, Class Members who filed valid claims for the Symantec Norton class action settlement began receiving checks worth as much as $400 on July 28, 2017.
If you filed a claim for the Norton settlement, keep checking your mailbox because your payout could be on its way.
The class action settlement resolves allegations that Symantec and Digital River failed to let customers know that buying “download insurance” for their Norton software was optional. According to the plaintiffs, customers who bought Norton products online were automatically given an option to buy insurance in their shopping carts.
The lawsuit claimed that customers were then informed that if they wanted to be able to download their software after the first 60 days, they would need to buy the download insurance. This was despite the fact that customers had purchased a license to use the Norton products for at least one year.
“By auto-populating the online shopping cart with Download Insurance, Defendants intentionally represented to consumers that the ‘insurance’ in some way protected their software purchase when, in fact, it was completely unnecessary to protect their software purchase because Symantec had a uniform policy of allowing customers to re-download purchased software at any time with or without the Download Insurance,” the Symantec class action states.
The defendants denied the class action claims but agreed to settle the litigation which was preliminary approved on Oct. 8, 2015. The settlement was subsequently appealed but in April 2017, the Court of Appeals affirmed its final approval.
Class Members included all U.S. Consumers who bought Extended Download Service (EDS) for Norton products or Norton Download Insurance (NDI) between Jan. 24, 2005 and March 10, 2011.
The deadline to file a claim for the Symantec Norton class action settlement passed on Feb. 18, 2016.
