The deadline to file a claim for a class action lawsuit settlement involving unsolicited fax advertisements is rapidly approaching. If you received an unsolicited fax from UScoot, LLC, promoting its goods, programs or services on or after March 26, 2005, you could be eligible to claim money from the settlement. Over 100,000 people are estimated to be eligible under this class action lawsuit.Â

The UScoot class action lawsuit alleges the scooter and electric wheelchair company violated the Telephone Consumer Protection Act (TCPA) by sending unsolicited facsimile advertisements. UScoot denies it did anything wrong, but has agreed to pay $525,000 into a settlement fund to end litigation. The amount remaining in the fund after attorneys’ fees and the lead plaintiff’s incentive award are deducted will be divided on a pro rata basis among people who submit timely claim forms. There are approximately 100,206 members estimated to be in the settlement class.

All claim forms must be faxed or postmarked by September 16, 2010. Those who wish to opt out or object to the class action settlement must also submit their intention to opt out or to object by September 16, 2010. Details on how to submit a claim form, opt out or object can be found in the class action settlement notice. The final approval hearing for the settlement will be held on October 15, 2010.

This isn’t the first unsolicited fax advertisement class action lawsuit settlement we’ve seen this year. Streetglow, Inc. settled a class action lawsuit earlier this year for $5 million — nearly nine times the amount of the UScoot settlement. Class members in the Streetglow settlement were able to receive up to $500 for each fax Streetglow sent them, up to a maximum of $1,500. Unfortunately, the deadline to file a claim for the Streetglow class action lawsuit settlement has passed. Â
