Spark email settlementViewers of Top Class Actions are reporting that checks for the Spark Networks class action settlement have been mailed. If you submitted a claim for this settlement, keep an eye on your mailbox, as you may soon be receiving a check in the mail. Some claimants have reported they received checks worth thousands of dollars from the Spark Networks class action settlement.

The Spark Networks settlement resolves a class action lawsuit alleging the company sent commercial emails for its dating sites that contained falsified, misrepresented or forged header information. These emails were allegedly misleading or deceptive because they did not identify Spark in the “from” field, the emails had inaccurate “sent” dates, contained domain names that were difficult to trace, had no method to unsubscribe from emails, or contained deceptive material in the email body or subject line. According to the Spark Networks class action lawsuit, these emails were sent in violation of California law.

Under the terms of the Spark Networks class action settlement, Class Members who submitted valid and timely Claim Forms were eligible to receive a cash payment of up to $450 for each qualified email they received. Class Members include anyone who, while living in California, received a commercial email advertisement that they believe was materially misleading, fraudulent or unlawful that was sent on behalf of Spark Networks since Oct. 16, 2008.

Spark Networks operates dating websites such as JDate.com, ChristianMingle.com, BlackSingles.com and Spark.com. The company denied any wrongdoing in the deceptive email class action lawsuit but agreed to pay $575,000 to avoid the cost and risk of further litigation. In addition to offering compensation to Class Members, Spark Networks also agreed to change its email practices to correct the issues listed in the deceptive email class action lawsuit.

To qualify for benefits from the class action settlement, Class Members had to submit a copy of the allegedly unlawful email (by providing the original email, photocopy, electronic copy or scanned copy of the email) along with verification that the submitted email was actually received and not fraudulent. Class Members could submit a claim for up to 200 qualified emails.

The Spark Networks class action settlement received final approval following a hearing on Feb. 25, 2015.

The deadline to file a claim for the Spark Networks class action settlement passed on Dec. 23, 2014.

    Christian Mingle at one time listed Sparta as their Network (verses Spark), which also sponsored a Gay Website. Why the change? Why was this not common knowledge to Christians or Gays?
