Visionworks settlement

Parties to two Visionworks class action lawsuits alleging a deceptive “Buy One, Get One Free” offer have reached a settlement agreement resolving both cases.

Consumers who made a qualifying “Buy One, Get One Free” purchase from Visionworks stores in Ohio and Illinois may be entitled to a settlement payment.

The plaintiffs claim that as part of its BOGO offer, eyeglass retailer Visionworks inflated the price of the first pair of glasses to partly cover the cost of the second and purportedly “free” pair of glasses.

The second pair was therefore not actually “free” as advertised, the plaintiffs claim. They allege Visionworks’ “Buy One, Get One Free” promotion violates the consumer protection laws of Ohio and Illinois.

The first Visionworks class action lawsuit was filed in June 2014 in Ohio state court, then removed to federal court. The original plaintiff voluntarily withdrew from that action in September 2016 and was replaced by current plaintiff Karen Poteat.

The second Visionworks class action lawsuit was filed in June 2016 by plaintiff Cheryl Lenart, in a federal court in Illinois. In September 2016, Lenart’s action was transferred to the Northern District of Ohio, to be handled together with Poteat’s action.

The parties agreed to this Visionworks settlement in January 2017. Under terms of the settlement, qualifying claimants may be entitled to cash payments from a settlement fund totaling $4.2 million.

Visionworks continues to deny the plaintiffs’ allegations, maintaining that it acted lawfully at all relevant times.

The objection or exclusion deadline for the Visionworks settlement is April 14, 2017.

Who’s Eligible

The Visionworks settlement offers compensation for two plaintiff Classes.

The Ohio Settlement Class consists of all consumers who made a“Buy One, Get One Free” purchase from a Visionworks store in Ohio between June 25, 2012 and Sept. 15, 2016.

The Illinois Settlement Class consists of all consumers who made a “Buy One, Get One Free” purchase from a Visionworks store in Illinois between June 8, 2013 and Sept. 15, 2016.

Potential Award

Up to $100

Class Members who submit a valid claim may be eligible for payments of up to $100 for each qualifying Visionworks purchase. Purchases of less than $100 may qualify for payments of the actual purchase amount.

Proof of Purchase

Claimants must certify that they made a qualifying Visionworks purchase and provide the month, year, and dollar amount of that purchase.

    Came here Sept. 24, 2017 for news about when settlement checks might be sent out. Have seen on line that it might take as long as 90 days for a check. Is that true?

      Yes that is true. Checks aren’t mailed until the time to file an appeal is over. If appeals are filed it can take longer than 90 days
