Pilot Flying J class action settlementJudge James Moody has given his final approval to Pilot Flying J’s class action settlement agreement with its trucking customers. The company is expected to pay out approximately $72 million to 5,500 Class Members.

This settlement will resolve the class action lawsuit alleging that Pilot Flying J’s CEO James A Haslam III implemented a “nationwide scheme to defraud and cheat” its trucking customers. Haslam III has denied knowledge about such wrongdoing but a number of class action lawsuits have accused him of giving his “blessing” to the scheme for the sake of boosting the company’s bottom line.

The class action settlement calls for Pilot Flying J to pay 100 percent of discounts that have gone unpaid, with 6 percent interest. The company will also shoulder the costs of internal audits, court fees and expenses. The breakdown of the $72 million is projected as follows: $55 million in owed fuel rebates, $4.1 million in interest, $3.5 million for auditing costs, and about $14 million in attorney’s fees.

There were no written objections against the class action settlement. The company reported that about 60 companies opted out of the settlement, the reason of which is unknown, but they can either pursue other legal options, like filing their own separate lawsuit.

It will be recalled that the Federal Bureau of Investigation (FBI) and the Internal Revenue Service (IRS) raided Pilot’s headquarters on April 15, 2013, after federal agencies received tips about its alleged cheating.

Based on the settlement agreement, there will be no claims filing process. Class Members will automatically receive the benefits of the agreement, except for those who opted out. The case is National Trucking Financial Reclamation Services, LLC, et al. v. Pilot Corporation, et al., Case No. 4:13-cv-00250-JMM, U.S. District Court for the Eastern District of Arkansas.
