A federal judge on Friday preliminarily approved a class action lawsuit settlement between Boiron Inc. and customers who say the company falsely advertised the effectiveness of its homeopathic cold medicine Children’s Coldcalm.
On May 31, 2013, U.S. District Judge Beverly Reid O’Connell said she found the Children’s Coldcalm class action settlement to be fair and reasonable, marking the first step toward ending the nearly three-year-old case.
Lead plaintiff Gina Delarosa sued Boiron in October 2010 for misleading consumers by advertising Children’s Coldcalm as an effective cold remedy when it actually did nothing to relieve cold symptoms.
Numerous class action lawsuits have been filed against companies that produce homeopathic medicine accusing them of selling homeopathic “remedies” that are nothing more than expensive sugar pills. Boiron has been the target of multiple class action lawsuits over its homeopathic products.
Under the Delarosa v. Boiron settlement deal, California residents who purchased Children’s Coldcalm for personal use since August 31, 2006 will be eligible for a full refund if they have a receipt or a refund of $12.99 per purchase if they only have the product’s packaging. Consumers who don’t have proof of purchase can claim a refund of $8 per purchase, up to a maximum of $16 per household.

The case is Delarosa v. Boiron USA Inc. et al., Case No.10-cv-01569, in the U.S. District Court for the Central District of California.
