True Athlete Training FormulaIn a new class action lawsuit filed Tuesday, California consumer Steven Hodges accuses Vitamin Shoppe Inc. of pushing a bogus pre-workout muscle building and performance enhancing product called True Athlete Training Formula that it knows is “useless.”

Hodges alleges in the class action lawsuit that Vitamin Shoppe had access, but “knowingly and/or recklessly ignored” all competent and reliable scientific evidence that the main ingredient in True Athlete Training Formula — L-Arginine Alpha Ketoglutarate — doesn’t enhance athletic performance, improve cardiovascular function or build muscle as advertised.

Furthermore, Vitamin Shoppe “knowingly under doses the remaining active ingredients to save money but still entice consumers by using efficacy claims for the compounds Creatine Monohydrate, Beta-Alanine (as Carnosyn), and AstraGin” – all well-known compounds in the sports industry, the class action lawsuit says.

“Defendant unapologetically, and with no remorse, boasts the inclusion of these popular ingredients in the Product, and then under doses them in the formula to make the Product useless,” the complaint states. “The inclusion of the ingredients at levels under the clinical dosage is nothing more than a new tactic at selling consumers ‘snake oil.’”

The True Athlete Training Formula class action lawsuit is brought on behalf of a proposed class of all persons in California who purchased the product from Vitamin Shoppe within the last four years.

It is seeking compensatory, consequential and special damages; punitive damages; injunctive relief and more for alleged false advertising, breach of express warranty, unjust enrichment and other violations of California law.

The Vitamin Shoppe True Athlete Training Formula Class Action Lawsuit case is Steven Hodges v. Vitamin Shoppe Inc., Case No. 13-cv-02849, U.S. District Court, Central District of California.

UPDATE: A federal judge dismissed the True Athlete Class Action Lawsuit on Jan. 15, saying the plaintiff’s claims lacked standing. The plaintiff will be allowed to file an amended complaint and try again.
