Floor & Decor laminate flooring

A settlement has been reached in a class action lawsuit alleging certain Chinese-made laminate flooring sold by Floor & Decor Outlets of America Inc. was mislabeled as being compliant with California regulations regarding formaldehyde emissions.

If you own Chinese-made laminate flooring sold by Floor & Decor between Jan. 1, 2012 and Aug. 1, 2015, you may be entitled to benefits from the class action settlement.

A group of plaintiffs filed the Floor & Decor class action lawsuit in December 2015, claiming that the company sold Chinese-made laminate flooring that did not comply with California Air Resources Board standards for formaldehyde emissions, and that it misrepresented that the flooring complied with the CARB standards.

Formaldehyde gas poses significant health risks and is listed by CARB as a contaminant with no safe level of exposure. To minimize the risk of formaldehyde exposure from laminate flooring, CARB set regulations limiting the amount of formaldehyde that may be present in the flooring.

According to the class action lawsuit, the CARB regulations apply to anyone who manufactures, distributes or sells flooring materials in California.

The plaintiffs state that they would not have purchased the laminate flooring from Floor & Decor if they had known it contained excessive levels of formaldehyde and did not comply with CARB standards.

Floor & Decor denies any wrongdoing and maintains that its products comply with all applicable laws and regulations. However, it has agreed to settle the laminate flooring class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

If you would like to object to or exclude yourself from the Floor & Decor class action settlement, you must do so no later than Nov. 21, 2016.

Who’s Eligible

Class Members of the laminate flooring settlement include current owners of Chinese-made laminate flooring sold by Floor & Decor between Jan. 1, 2012 and Aug. 1, 2015.

To determine whether the laminate flooring you purchased is covered by the class action settlement, you can review the SKU number listed on your store receipt or packaging label and enter the number in the SKU Lookup feature on the settlement website.

Potential Award

Varies.

Class Members may choose to receive either a cash payment of $1.50 per square foot or a store credit of $3 per square foot based on the total square footage of the laminate flooring you purchased or is currently installed in your building.

Proof of Purchase

If you received notice of the Floor & Decor settlement via mail or email, you should provide the Claim Number listed in the notice.

If you do not have a Claim Number, you can contact the Settlement Administrator to obtain one. You can submit a claim without a Claim Number, but you will need to provide proof of purchase, such as a receipt, invoice or credit card statement.

NOTE: Testing Subclass members must submit a flooring sample to determine whether they are eligible to receive a cash payment or a store credit.

    I purchased and had laminate flooring installed from Floor and Decor. I submitted my claim on time and never received any sort of settlement check. I still have my postcard that came in the mail with my claim number on it. Can someone please contact me with any information regarding this settlement?.
