A judgment has been entered in favor of certain employees who worked at Walmart and Sam’s Club Stores. If you worked as an hourly employee at a Walmart or Sam’s Club store between Mar. 19, 1998 and May 1, 2006, you may be entitled to payment from this class action lawsuit.

The plaintiffs filed the Walmart class action lawsuit seeking redress for missed meal and rest breaks and for off-the-clock work that employees allegedly performed when employed by Walmart.

They asserted claims for breach of contract, violations of the Pennsylvania Minimum Wage Act, violations of the Pennsylvania Wage Payment and Collection Act, restitution and unjust enrichment.

This Walmart lawsuit was certified as a class action lawsuit on Dec. 27, 2005. Approximately 187,000 current and former Pennsylvania employees may be entitled to benefits from the Walmart class action lawsuit.

On Oct. 13, 2006, a jury returned a $78.5 million verdict in favor of Walmart Stores Inc. employees who were forced to miss rest breaks and work off the clock in Pennsylvania between Mar. 19, 1998 and May 1, 2006.

A judge awarded Class Members an additional $62.3 million in statutory damages. Approximately 124,500 Class Members are entitled to statutory damages.

Walmart appealed the verdict and the appeal reached the U.S. Supreme Court. However, the high court refused to hear the case earlier this year. Therefore, the judgment stands.

Who’s Eligible

Class Members include hourly employees who were employed by Walmart or Sam’s Club stores in Pennsylvania between Mar. 19, 1998 and May 1, 2006.

According to the settlement website, payments are expected to be made by the end of 2016.
