Expert-Med Fax Spam TCPA Class Action Settlement

A settlement has been reached in a class action lawsuit alleging The Harvard Drug Group LLC d/b/a Expert-Med violated the Telephone Consumer Protection Act (TCPA) by sending fax advertisements without the express permission of the recipients.

If you received a faxed advertisement from Harvard Drug between Apr. 30, 2009 and Apr. 30, 2013, you may be entitled to payment from this TCPA class action settlement.

The Telephone Consumer Protection Act is a federal law that was implemented to protect consumers from solicitations from companies that do not have permission to contact them. The TCPA prohibits companies from placing robocalls, sending unsolicited text messages and sending fax advertisements without the consent or permission of the recipient.

According to the TCPA class action lawsuit, Harvard Drug sent faxes to fax machines and/or computers for the purpose of marketing products or services. However, the company allegedly sent these faxes without the consent of the recipient and failed to include an opt-out notice.

The plaintiffs assert that Harvard Drug violated the TCPA by failing to obtain consent before sending faxes and by failing to provide information about how to opt out of the fax spam.

Harvard Drug denies any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the burden and expense of ongoing litigation.

The company has established a $415,500 settlement fund in order to pay valid claims, administration costs and other awards and costs associated with the TCPA settlement.

The Expert-Med class action settlement was preliminarily approved on July 22, 2016.

If you would like to opt out or object to the Harvard Drug fax spam settlement, you must do so no later than Oct. 25, 2016.

Who’s Eligible

Class Members of the Expert-Med fax spam settlement include anyone in the United States who received a faxed advertisement from Harvard Drug promoting the commercial availability of goods, property or services between Apr. 30, 2009 and Apr. 30, 2013.

Up to $500.

N/A.

Claimants must verify the ownership of the fax number that received the unsolicited Expert-Med fax advertisement.
