Stryker Class Action SettlementTop Class Actions viewers are starting to receive checks in the mail from a class action settlement that accused Stryker Sales Corporation, Stryker Corporation, Stryker Biotech LLC, and Howmedica Osteonics Corp. of violating the Telephone Consumer Protection Act by sending out junk faxes.

According to reader comments and posts on the Top Class Actions Facebook page, Class Members who submitted timely and valid claims for the Stryker TCPA settlement began receiving checks worth as much as $1,500 on Aug. 2, 2016.

The class action settlement resolves allegations that Stryker or Howmedica sent unsolicited fax advertisements without a proper “opt-out” notice within the fax itself.

Class Members of the Howmedica class action settlement included: “All persons who (1) on or after four years prior to the filing of this action, (2) were subscribers of a fax number that received, (3) a fax invitation to attend a presentation for primary care physicians on advancements in orthopedics, arthritis, joint replacement, or joint treatment options, (4) received from one or more of Defendants, and (5) that did not display a proper opt-out notice.”

Stryker denied the allegations but agreed to pay $6.85 million to settle the claims and avoid the cost of further litigation.

The deadline to file a claim for the Stryker class action settlement passed on Jan. 15, 2016.
