A settlement has been reached in a class action lawsuit alleging Stryker Sales Corporation, Stryker Corporation, Stryker Biotech LLC, and Howmedica Osteonics Corp. violated the Telephone Consumer Protection Act by sending unsolicited fax advertisements.
If you received one or more unsolicited faxes from Stryker or Howmedica that did not display a proper opt-out notice, you may be entitled to benefits from the TCPA class action settlement.
If approved, the settlement will resolve a TCPA class action lawsuit alleging the defendants violated the federal Telephone Consumer Protection Act by sending unsolicited advertisements by fax. Specifically, the TCPA class action lawsuit claims the defendants faxed invitations to attend a presentation for primary care physicians on advancements in orthopedics, arthritis, joint replacement or joint treatment options.
The defendants deny the allegations but agreed to pay nearly $6.85 million to settle the TCPA class action lawsuit.
If you wish to object to or exclude yourself from the Howmedica TCPA class action settlement, you must do so no later than Jan. 15, 2016.

Who’s Eligible
Class Members of the Howmedica class action settlement include: “All persons who (1) on or after four years prior to the filing of this action, (2) were subscribers of a fax number that received, (3) a fax invitation to attend a presentation for primary care physicians on advancements in orthopedics, arthritis, joint replacement, or joint treatment options, (4) received from one or more of Defendants, and (5) that did not display a proper opt-out notice.”
The Stryker class action lawsuit was initially filed in July 2012.
Potential Award
Up to $500 per fax. The actual amount per fax may be reduced on a pro rata basis depending on the total number of valid claims filed.
Proof of Purchase
N/A. However, Class Members must be prepared to provide verification that they subscribed to the fax number that received the qualifying fax(es).
