RushCard Class Action Lawsuit

A settlement has been reached in a class action lawsuit that alleges RushCard prepaid debit holders experienced a lengthy service disruption that caused them to be unable to access their money. If you were a RushCard prepaid debit card holder on Oct. 12, 2015, your rights may be affected by this class action settlement.

If approved, the RushCard settlement would resolve four class action lawsuits that were filed against UniRush LLC d/b/a UniRush Financial Services, Rush Communications LLC, Rush Communications of NYC Inc., Meta Financial Group Inc., MetaBank, and MasterCard Incorporated.

According to the RushCard class action lawsuits, UniRush LLC offers the RushCard to consumers through an agreement with MetaBank, the card issuer. On Oct. 12, 2015, a subsidiary of MasterCard became the processing company for RushCard services. RushCard holders were notified in advance that there would be a short disruption in service on Oct. 12, 2015 to allow for the conversion to take place.

However, the plaintiffs allege, the RushCard service disruption was longer than anticipated and left many users without the ability to access the funds in their accounts. According to the RushCard class action lawsuits, many cardholders were unable to pay for basic necessities such as food, rent, gas and electricity. Some cardholders reported discrepancies in their RushCard account balances, and some claim they were charged for balance inquiry fees when they attempted to withdraw money from ATMs while the RushCard system was down.

The defendants deny any wrongdoing but have agreed to pay $20.5 million to settle the RushCard class action lawsuits and avoid the burden, expense and uncertainty of ongoing litigation.

Class Members who wish to opt out of or object to the RushCard class action settlement must do so no later than Aug. 30, 2016.

Who’s Eligible

Class Members of the RushCard settlement include all cardholders with an open RushCard account as of Oct. 12, 2015 and who had authorized the use of that account at least once between July 14, 2015 and Oct. 12, 2015.

Potential Award

Up to $500 for reimbursement for losses suffered during the service disruption plus reimbursement of fees.

Class Members are eligible to receive reimbursement of fees incurred during the service disruption and a cash payment for losses they experienced due to the service disruption.

Proof of Purchase

Class Members who wish to obtain a cash payment must submit a Claim Form by Aug. 30, 2016. If you submit documentation of your losses, you may be eligible for a payment of up to $500. Class Members who do not submit documentation of their losses may receive a cash payment of $100. Payments may be reduced on a pro rata basis depending on the total amount of approved claims.

NOTE: No Claim Form is required for Class Members to receive a reimbursement of fees. Class Members will automatically be reimbursed for all fees assessed on their RushCard accounts during the period of Oct. 12, 2015 through Oct. 31, 2015 (except for fees that were previously reimbursed or credited to the user’s account).

Monthly fees for the month of October 2015 will be prorated so that Class Members will be reimbursed only for the portion of the fees allocable during that time period.

    I have been trying for more than a year to reach RC, to view my monthly statements. I cannot access my mobila RC account, because the app ERRONEOUSLY states I insert the wrong social security number, cvv number and/or my expiration number. BS, I know my own info being requested and I double check, before submitting.

    IT IS IMPOSSIBLE TO TALK WITH A RC ASSOCIATE OVER THE PHONE.

    I NEVER RECEIVED NOTICE OF THE LAWSUIT OR THE SETTLEMENT, EITHER FROM RC OR THE FIRM, THAT PURPORTEDLY REPRESENTED ME AND MY INTERESTED. AS AN ATTORNEY, MYSELF, WHO WAS ASSOCIATED ON A CASE THAT SETTLED FOR $500+ MILLION, I KNOW THAT THE MONEY CANNOT BE DISBURSED, UNLESS THERE IS A CERTIFICATION CLASS MEMBERS (ACTUAL NAMED AND UNNAMED PLAINTIFF) HAVE RECEIVED NOTICE OR A SWORN DECLARATION THAT DUE DILIGENCE WAS MADE TO NOTICE ALL PARTIES, WITH A CREDIBLE CLAIM.

    Ok i have been with Rush card for four years and in that four years they have caused me so many problems I really don’t know where to start im disabled and I have lost my home and way of living because of these Rachid people I really wish they would close these people down for good and never be able to do anyone in such a inhumane way again im not joking ? my life has been living hell!

    I have not received any of my fees! Rushcard has blocked account seveal times after I jyst asked about pending transactions. I had to go without money and pay a $39.95 fee which has happened twice. While I was in crisis may account couldn’t be accessed because theur was something wrong with your computers. I have filled out papers several times and still no money.
