Omaha steaks class action settlement

A class action settlement has been reached with Omaha Steaks Inc. over allegations that the food company violated the Telephone Consumer Protection Act (TCPA).

According to the lawsuit filed by plaintiff Michael Hetherington, Omaha Steaks placed phone calls to cell phones (and other phone numbers where the call recipient was charged for the call) using an automatic telephone dialing system (ATDS). An ATDS uses a number generator to produce random or sequential phone numbers that are then dialed and the call is placed.

The plaintiff alleged that thousands of these autodialed phone calls were placed over the last four years to cell phone customers without their previous express written consent to receive such calls, in violation of the TCPA.

Omaha Steaks denied any wrongdoing and assert that they have not acted improperly under the law. They stated that they believe to have many defenses to ensure their success at a trial, including their belief that a Class would not be granted certification.

However, Omaha Steaks agreed to enter into a settlement with the plaintiff and Class to avoid the cost of a trial. The plaintiff as Class Representative and Class Counsel feel this settlement is in the best interest of Settlement Class Members.

Omaha Steaks agreed to pay between $4.5 and $5.2 million to resolve the claims in the TCPA class action lawsuit.

Class members wishing to exclude themselves or object to the settlement must send their request by mail postmarked no later than June 3, 2016.

Who’s Eligible

All persons and entities to whom OS placed calls to their cellular telephones through means other than manually dialing each digit of the telephone number during the time period from and including December 9, 2009, through and including December 17, 2013, without their prior express consent.”

Up to $60 cash or up to $80 for a Reward Card redeemable at Omaha Steaks

    Yes, I got a reembursement coupon that I can only redeem IF I purchase from Ohamah Steaks! WTF would I purchase from them after this period! The lawsuits is BENIFITING OMAHA STEAKS INTHAT THOSE OF US CALLED NOW HAVE TO PURCHASE FROM OMAHA STEAKS TO RECEIVE OUR LAWSUITE AWARD? How is that punishing them for calling us? We have to spend more money than the award was to purchase anything from them!
    Good Gawd, it is scared when a Classaction Suite totally helps the defendant get more business from the victims ! WTF…anyone else agree?

    Redeemed my $27.48 in CA 02/18/17. The “compensation” is a postcard, with the benefit code printed on it to be entered like a coupon at check-out. It is marked as “Transferrable”; so basically anyone who sees it can use it.

      Why should you even be FORCED To spend Your lawsuit Award to the Company who LOST the suit, or Settled out? Huaaaaa? He Attornies who won this suit should be sued for FORCING us victims to purchase from the losing suit Member ! Or maybe Omaha Steaks paid off the Attis in Free food for them to stupidly let Omaha Steaks issue a coupon to purchase a discount on items that are rarely Under 50$ unless it is an add-on to a larger purchase. WTF

        I’d be more than happy to take the coupon code off your hands if you’re not interested. I personally felt the remediation was more than adequate for receiving a phone call three years ago, that probably lasted less than a minute before I hung up, and that I don’t remember. The company will suffer an actual loss to profits if people use the discount codes-for example, I used my in conjunction with a sale, a $10 off coupon and a free shipping code, and ended up spending about $10 on products totaling about $150.00 retail from their site. A small cash payout would have hurt them more, but lawsuits aren’t about hurting the losing party, as much as making the winning party whole.
