Ghirardelli Chocolate Class Action Settlement Checks Mailed

Top Class Actions readers are starting to receive settlement checks from a class action lawsuit that accused the Ghirardelli Chocolate Company of falsely advertising its white baking chips.

According to reader comments and posts on our Facebook page,Class Members who filed a valid and timely claim for the Ghirardelli settlement began receiving checks worth as much as $33 on Mar. 15, 2016.

The Ghirardelli settlement resolves allegations that the chocolate maker mislabeled “Ghirardelli Chocolate Premium Baking Chips – Classic White” (white chips) as containing chocolate even though they don’t.

As part of the settlement terms, the company agreed to pay $5.2 million as well as stop using the terms “chocolate indulgence” and “baking chocolate” on its white chips packaging.

Ghirardelli denied any wrongdoing and argued that its white chips are not mislabeled. However, the company agreed to the terms of the settlement to avoid the cost and risks of further litigation.

Class Members who filed a valid Claim Form were told to expect a check up to $24 without a receipt and a higher award if they could submit a proof of purchase.

Ghirardelli settlement Class Members included all U.S. residents who purchased certain allegedly mislabeled Ghirardelli products between Aug. 17, 2008 and Oct. 2, 2014.

The deadline to file a Claim Form for the Ghirardelli settlement passed on Mar. 19, 2015.
