Bayer HealthCare is facing a barrage of Essure injury claims from over a dozen plaintiffs alleging serious complications.
In each of these Essure injury claims, the claimant alleges the permanent birth control device caused her to experience permanent injuries, with some forced to undergo total hysterectomy to resolve the injuries.
Several plaintiffs in this multi-plaintiff Essure lawsuit are women who were directly affected by Essure complications. Others are close relatives filing on behalf of injured patients who could not file themselves.
The Essure birth control device consists of a pair of metal coils which are each implanted into the patient’s fallopian tube. Eventually the tissue of the fallopian tubes will swell around the coils, ultimately preventing sperm to egg fertilization.
The Essure birth control device is the only form of non-surgical permanent female sterilization available in the United States, making it very popular for women.
However numerous women have reported device complications. They allege Essure’s manufacturer did not adequately warn them about potential device failure, migration or even allergic reactions.
Overview of Essure Injury Claims
Due to the similar nature of the Essure injury claims, over twenty different women have filed together in this single Essure lawsuit. Each of these women opted for the Essure birth control device for its convenient and pain-free procedure.
Some of the women involved in the Essure injury claims include:
- Plaintiff Amanda A. opted for Essure birth control after going over different contraceptive options with her physician. She had Essure implanted in June 2010, but she says she began experiencing complications just a month later. On November 2014, Amanda reported she was still suffering from the same complications and it was later confirmed that these problems were caused by Essure birth control.
- Plaintiff Jennifer B. opted for the Essure birth control device after discussing different options with her physician. She says she underwent the implantation procedure on Sept. 25, 2015 but began experiencing odd symptoms soon after the surgery including extreme pelvic pain and menstruation complications. After suffering abnormal menstrual bleeding, Jennifer reportedly tried to have the device removed through surgery on Oct. 21, 2015. But during surgery, she says, her surgeon was unable to find her Essure implants.
- Plaintiff Angela B. chose the Essure birth control device after reviewing different options and had the device implanted on June 17, 2011. However, soon after the procedure, Angela says she had to see her physician for a follow-up appointment due to menstruation problems and severe pelvic pain. Diagnostic imaging confirmed the device had migrated away from its implant spot. Due to her Essure complications, Angela says she had to undergo a hysterectomy on Aug. 17, 2011 to resolve the complications and remove the device.
Each of these women involved in the Essure injury lawsuit alleges the company gave her no prior warnings before November 2016. The plaintiffs allege Bayer HealthCare failed to properly notify them of potential complications. These women say they would not have used the device if they knew.
This Essure Injury Claims Lawsuit is Case No. 3:17-cv-00671-MMA-WVG, in the Superior Court of California, County of San Diego Unlimited Jurisdiction, Central Division.
In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
