A class action lawsuit against Best Buy Stores is currently pending regarding the implementation of its price match policy in New York stores. New York residents who tried but failed to receive Best Buy’s “price match guarantee” at any time within the past nine years may be entitled to cash benefits if the class action settlement is approved.

The Best Buy class action lawsuit alleges the electronics retail chain uses false and deceptive trade practices in advertising and applying the company’s well-known “price match guarantee” policy. Best Buy tells consumers that it will match a competitor’s lower price on any item purchased in the store, subject to certain exclusions. However, the plaintiff in the Best Buy price match class action alleges Best Buy uses its price match guarantee policy as a ploy to lure unsuspecting consumers into its stores and to induce them to purchase its merchandise, while allegedly having an undisclosed policy that requires employees to aggressively deny and discourage consumers’ legitimate price match requests.

Class members in the Best Buy price match class action lawsuit settlement include all New York citizens and residents who, from January 10, 2002 through the present, made a purchase at a Best Buy and within 30 days after purchase (14 days for computers, monitors, notebook computers, printers, camcorders, digital cameras and radar detectors), found a lower price from another store qualifying under Best Buy’s published price match guarantee on an available product of the same brand and model, and provided verification of the lower price to Best Buy, but were denied the benefit of Best Buy’s price match guarantee. 

The Court also certified a Subclass of persons within the Class whose claims under New York General Business Law are ineligible because their injury occurred prior to January 10, 2005.

As of now, no settlement has been proposed in the case, but the original class action lawsuit documents show the Plaintiff was seeking compensatory and/or restitution or refund of all funds acquired from Class Members as a result of Best Buy’s alleged unlawful, unfair and fraudulent business practices.

To remain a member of the Best Buy price match settlement Class, you do not need to do anything at this time. If a recovery is made, you may be entitled to share in the proceeds of the class action settlement. If you wish to exclude yourself, however, that deadline has passed.
