Chantix Recall 2021 Class Action Lawsuit Overview: 

  • Who: A New York woman has lodged a class action lawsuit against Pfizer, Inc. 
  • Why: The plaintiff claims Pfizer sold varenicline-containing drugs misbranded as Chantix because they were contaminated with probable human carcinogens. 
  • Where: The class action lawsuit is pending in New York federal court. 

Pfizer, Inc. knowingly sold varenicline-containing drugs (VCDs) under the brand name Chantix which were contaminated with probable human carcinogens, a new class action lawsuit alleges.

Plaintiff Shannon Webb claims Pfizer “willfully ignored warnings about the operating standards,” and fraudulently manufactured, sold, labeled, and marketed VCDs contaminated with n-nitroso vareniclin. The class action comes after the drug company issued a Chantix recall in the summer of 2021.

Pfizer was also on notice for the presence of other nitrosamines such as n-nitrosodimethylamine and n-nitrosodimethylamine, according to the class action lawsuit. 

Webb wants to represent a nationwide Class and a New York subclass of consumers who paid for VCDs manufactured, distributed, or sold by Pfizer. 

Webb claims she purchased VCDs from Pfizer that were purported to be the same as branded Chantix, however, she later discovered it was not the same because of the “impurities,” it contained. 

“(Pfizer’s) VCDs were not fit for their ordinary use and (Pfizer) has been unjustly enriched through the sale of these knowingly adulterated and/or misbranded drugs,” states the class action lawsuit. 

Pfizer Issues Chantix Recall 2021

Pfizer initiated a recall of its VCDs on July 2 after revealing they contained unacceptable levels of N-nitroso-varenicline, according to the class action lawsuit. The company ultimately extended the recall to all of Chantix, in September.

Webb claims the contamination dates back many years and that Pfizer was aware of the contamination well before the recall. 

“Ironically, (Pfizer’s) wrongful acts resulted in persons who sought to use smoking products less end up with a Chantix pill that contained a carcinogen,” states the class action lawsuit.  

Webb claims that, because of the contamination, millions of VCD consumers sustained economic damages by purchasing products that were illegally and willfully introduced by Pfizer. 

“(Pfizer’s) VCDs were not fit for their ordinary use and Defendant has been unjustly enriched through the sale of these knowingly adulterated and/or misbranded drugs,” states the class action lawsuit. 

Webb claims Pfizer is guilty of fraud, unjust enrichment, and negligence, among other things, and is in violation of a number of state consumer protection laws and the Magnuson-Moss Warranty Act

Webb is demanding a jury trial and requesting injunctive relief in addition to all damages, exemplary or punitive damages, and/or restitution for herself and all Class Members. 

A separate class action lawsuit was filed against Pfizer last month by a Pennsylvania consumer alleging the company sold misbranded Chantix containing probable human carcinogens

    TOOK CHANTIX PLENTY OF TIMES AND STILL HAVE IT IN MY CLOSET AFTER THE RECALL, ALWAYS FELT NAUSEAU AFTER TAKING IT, ALONG WITH HORRIBLE NIGHTMARES.
