LG Blu-ray home theater class action settlementA New Jersey federal judge has granted final approval to a class action settlement involving allegations that LG Electronics USA Inc. concealed a defect in its Blu-ray home theater systems. Class Members still have until Jan. 2, 2014 to file their claims.

U.S. District Court Judge Jose L. Linares affirmed the approval on Dec. 2, 2013, after granting preliminary approval on Sept. 3. The final approval paves the way for those who purchased an LG LHB975 Network Blu-ray Disc Home Theater System to be eligible for a warranty extension and refund for repair costs.

LG denied all of the allegations but agreed to reimburse Class Members under the class action lawsuit settlement. Under the terms of the LG Blu-ray class action settlement agreement, the company has agreed to issue a warranty extension and reimbursement for past and future repairs of the home theater system. LG will provide a limited extended warranty for four years after the Home Theater System’s original one-year warranty start date or in service date, for a total warranty of five years.

LG will also reimburse Class Members for 100% of costs incurred in connection with covered repairs to the Home Theater System. For repairs that are made after the Effective Date of the class action settlement, if LG is unable to resolve the problem after two repairs, LG will make a cash payment according to the following schedule:

  • For repairs within the first 12 months of the warranty, LG will pay 100% of the cost of the home theater system.
  • For repairs within months 13-60 of the limited extended warranty, LG will pay 100% of the cost of the Home Theater System less 2.08 percent per month for depreciation.

Class Members do not have to take any action to receive the warranty extension. To be eligible to receive a cash refund for covered repairs, Class Members must submit a Claim Form. Take note that you still have time to file a claim. Your claim must be postmarked no later than Jan. 2, 2014 in order to receive a cash award. Claim filing instructions can be found here.

Excluded from the Settlement Class are: (a) persons who purchased the Home Theater System for resale; (b) persons who excluded themselves from the Settlement Class; (c) persons who have settled with and released Defendant from individual claims that are substantially similar to those alleged in this Litigation or persons who have had adjudicated claims substantially similar to those alleged in this Litigation; (d) any officer, director, or employee of Defendant or its subsidiaries and affiliates; (e) persons who have suffered personal injury as a result of the defects alleged; and (f) the presiding judge.
