The city of Normandy, Missouri, has agreed to pay $1.3 million to resolve class action lawsuit claims of unlawful arrest. The city allegedly arrested individuals because they couldn’t pay citations for minor offenses.

The settlement benefits two classes. 

The first class includes individuals who were incarcerated by the city of Normandy between Sept. 10, 2013, and May 12, 2021. The second class includes individuals who paid a fine, fee, cost, surcharge or other monetary sum to the city or who were subject to an arrest warrant from the city between Sept. 10, 2013 and May 12, 2021. Class members may be a part of one or both classes.

Normandy is a Missouri city in St. Louis County. According to the city’s website, Normandy is progressive and believes in integrity and ethical conduct.

However, Normandy allegedly violates its constituents’ constitutional rights with unlawful arrests and incarcerations.

An unlawful arrest class action lawsuit against Normandy contends the city arrested and incarcerated individuals because they couldn’t afford to pay the fines for traffic violations and other minor offenses. Similarly, the city allegedly put out warrants for arrests and forced individuals to pay further fees due to unpaid fines.

Plaintiffs in the class action lawsuit argue that these actions violated their constitutional rights.

Normandy hasn’t admitted any wrongdoing but agreed to pay $1.3 million to resolve these allegations.

Under the terms of the settlement, class members can collect a cash payment based on the number of hours they served in jail during the class period. 

Class members who served six to 48 hours of their arrest will be compensated at a rate of $7.50 per hour. Any hours above 48 hours will be compensated at a rate of $15 per hour. 

Class members can collect an additional payment if they were either subject to an arrest warrant or paid fines to the city. 

Class members who were subject to arrest warrants will receive an extra $20, while class members who paid the city will receive an extra $60. Class members can not receive both of these payments, but will receive the highest possible bonus payment based on their circumstances.

The deadline for exclusion passed on May 23, 2022. 

The deadline for objection in the settlement is Aug. 6, 2022. 

The final approval hearing for the Normandy unlawful arrest lawsuit is scheduled for Sept. 14, 2022.

In order to receive a payment from the settlement, class members must submit a valid claim form by Aug. 6, 2022.

    I’ve submitted my claim like everyone else and was told that the final hearing would be January third twenty twenty three. As of today 27th of January ’23 and I haven’t been contacted yet by anyone concerning the payment expected date. I was under the impression that payments would go out the same week of 1/3/2023. Does anyone have any updated information concerning the lawsuit filed against the city of Normandy .
