Pret A Manger Employee Fingerprint Class Action Lawsuit Overview:

Pret A Manger (USA) Limited has reportedly agreed to settle a class action lawsuit alleging it violated the Illinois Biometric Information Privacy Act (BIPA) by collecting employees’ fingerprints without their informed consent and failing to have a publicly available policy regarding the retention and destruction of this sensitive information.

On Jan. 12, plaintiff Kayla Quarles asked an Illinois federal judge to grant preliminary approval to the proposed Pret A Manger class action settlement, which would require the international sandwich chain to pay $677,450 to nearly 800 class members.

What Does the Pret A Manger Class Action Allege?

Quarles alleges Pret A Manger required new hires to scan their fingerprints to enroll in the company’s employee fingerprint database and then use their fingerprints to clock in and out of work.

This method of scanning employees’ fingerprints for timekeeping purposes allegedly violates BIPA in two important ways, according to the class action lawsuit.

First, Pret A Manger allegedly failed to provide the necessary disclosures or failed to receive informed written consent before collecting employees’ fingerprint data.

Second, Pret A Manger allegedly failed to implement a publicly available policy regarding the retention and destruction of employees’ biometric data.

Who Is A Class Member Of The Proposed Pret A Manger Settlement?

The Pret A Manger settlement documents define the proposed class to include all individuals employed by Pret A Manger in Illinois who utilized any software or devices that used the employee’s biometric identifier such as a finger or hand since Nov. 4, 2015.

Checks will automatically be mailed to eligible class members if the Pret A Manger settlement is approved. Each eligible class member is expected to receive a payment of $518.
