Paramount Pictures failed to pay its movie crew members their wages in full in a timely fashion, a new class action lawsuit alleges.
Plaintiff Timothy O’Cain’s class action lawsuit claims Paramount failed to properly pay crew members on “numerous” production efforts, including “Top Gun,” “Fatal Attraction” and “Snake Eyes,” among multiple others.
O’Cain says Paramount did not reimburse crew members for their cell phone expenses, make prompt payment of wages, or provide “timely, uninterrupted meal periods and rest breaks,” in violation of California law.
“By failing to pay Plaintiff and Class Members all wages when due at termination, Plaintiff and Class Members are entitled to continuing wages pursuant to section 203 of the California Labor Code,” the Paramount class action says.
O’Cain wants to represent a class of individuals who were paid wages for services provided for Paramount in the production of motion pictures in California in the past three years, and another class of similarly situated individuals who were paid within approximately the past four years.
Paramount required movie crew members to carry walkie talkies on breaks, class action claims
O’Cain argues Paramount either failed to provide breaks or required its movie crew members to keep their walkie talkies and cell phones on them at all times, including during meal breaks and rest periods.
“This policy precluded Defendants from providing Plaintiff and others the ability to enjoy legally compliant meal and rest breaks as required by California law,” the Paramount class action says.
O’Cain claims Paramount is guilty of violating a number of California Labor Codes. He demands a jury trial and requests an award of unpaid wages, damages, civil penalties, statutory penalties and attorneys’ fees and costs.
A pair of consumers filed a separate class action lawsuit against Paramount late last year over claims the company failed to honor subscription cancellations for its Paramount+ streaming service.
