Netflix has been hit with yet another class action lawsuit — this time by employees who claim the company stiffed them out of overtime and breaks for the past four years.
The employees allege in the wage and labor class action lawsuit that, for the last four years, Netflix “consistently maintained and enforced against non-exempt employees” the following illegal practices and policies, in violation of California state wage and hour laws:
* failure to pay hourly wages and overtime wages;
* failure to provide rest periods and meal periods or compensation in lieu thereof;
* failure to pay wages in a timely manner;
* knowing and intentionally failing to provide itemized wage statements; and
* violation the Unfair Competition Law.
The Netflix overtime class action lawsuit is brought on behalf of all current and former Netflix employees in the State of California who have worked as non-exempt hourly employees in the last four years and were not paid all lawful wages, including, but not limited to, all regular and/or overtime. It is also seeking to represent two subclasses of Class Members who did not receive a minimum 10-minute rest period for every four hours they worked or a 30-minute meal break each day they worked, or compensation in lieu of such breaks.
The complaint is seeking unpaid wages and overtime compensation, unpaid meal and rest period compensation, penalties and other equitable relief.

The case is Brunella M. Conti Gaggero v. Netflix, Inc., Case No. 112-cv-226587, Superior Court of the State of California, County of Santa Clara.
