Two Farms Inc., doing business as Royal Farms, has agreed to pay up to $995,000 as part of settlement resolving a class action lawsuit that alleged the company failed to provide overtime pay to certain employee participants in the Store Leader in Training program.

Salaried employees who were classified as exempt from overtime and who participated in the Royal Farms Store Leader in Training program from Dec. 22, 2018, to Dec. 21, 2021, may be entitled to compensation from the unpaid overtime settlement.

The Royal Farms settlement will resolve a class action lawsuit alleging Royal Farms violated the federal Fair Labor Standards Act (FLSA) by misclassifying employees as exempt from overtime and by failing to pay overtime compensation to employees who participated in the Store Leaders in Training program.

Royal Farms denies any wrongdoing but agreed to settle the unpaid overtime class action lawsuit to avoid the burden, uncertainty and expense of ongoing litigation.

Royal Farms is a chain of more than 200 convenience stores in Delaware, Maryland, Pennsylvania, New Jersey, Virginia, and West Virginia. The Store Leader in Training program is required for an employee to become a Royal Farms Store Leader, a job description that includes supervision and training of store employees.

The settlement notice sent to collective members includes a settlement payment estimate of what that individual is expected to receive. This estimate is based on the number of applicable weeks the collective member was employed as a salaried, exempt-classified Store Leader in Training.

To submit a claim online, collective members must provide the Claimant ID Number that was printed on the collective action settlement notice they received. Collective members who did not receive a notice of the Royal Farms settlement can contact the settlement administrator.

Claimants will be mailed a settlement check, and will have 120 days from the date it was mailed to deposit or cash the check.

Settlement funds that are not claimed by eligible collective members will revert to Royal Farms.

The Royal Farms employee overtime pay settlement has been approved.

Collective members must submit a completed claim form to the settlement administrator no later than Aug. 25, 2022.
