Lawsuit Says Unum Failed to Properly Assess Disability Insurance Claim

A Florida woman says that despite filing a claim for long-term disability benefits and making a more informative appeal, Unum claim denial specialists have continued to refuse to pay benefits according to the company’s own policy.
Sharon Allen first filed her application for monthly payments under her Unum disability insurance policy, which was denied on June 22, 2012. The company received her appeal on Dec. 18, 2012, but again denied her benefits at the end of February 2012. Her disability insurance lawsuit alleges that Allen meets the definition of a disabled employee and should receive back pay and additional benefits. However, the Unum disability insurance lawsuit does not note what specific medical condition the woman faces or what evidence she used to support her initial application and appeal.
In general, Unum lawsuits have focused on several types of action that allegedly contravene the company’s policy or are illegal under the Employee Retirement Income Security Act of 1974 (ERISA):
1) Failing to match the beneficiary’s condition with their actual job duties. Several recent lawsuits have alleged that company officials deemed a plaintiff able to work in a job, which contradicts the standard Unum disability insurance policy that only requires the condition preclude them from their work duties at their last position covered by the policy.
2) Refusing to account for additional medical evidence or excluding it during the appeals process without citing any rationale where a doctor’s opinion would not be valid.
3) Issuing capricious denials of monthly payments without articulating a clear reason to beneficiaries and without providing information in the claim denial documentation that would allow former employees to improve their application for long-term disability benefits governed by ERISA.
