Delivery worker with boxesA group of California-based FedEx drivers has reached a $5 million settlement agreement that will bring an end to their wage and hour lawsuit.

According to the lawsuit, FedEx broke several CA labor laws in their dealings with the drivers, including the denial of meal and rest breaks, as well as denial of proper overtime pay.

Law360 reports that the uncertified class includes approximately 11,500 FedEx delivery drivers. Class Members include current and former FedEx nonexempt delivery drivers who worked in California sometime between September 2013 and the present. Each of these Class Members is eligible to receive a portion of the settlement amount.

The settlement comes in lieu of litigation, which though it could potentially have recovered more in damages, would likely be a drawn-out and expensive process. With this settlement agreement, the issue is brought to a close quickly and easily instead of involving a years-long appeal process. Plus, eligible drivers will be paid promptly under the terms of this settlement.

The lawsuit was first filed by Maria H. in September 2017, alleging that FedEx did not allow drivers proper breaks. Instead, the company told drivers that breaks should be taken when employees determine they can.

On top of this, employees had to remain on call. According to Maria, FedEx even went so far as to set unrealistic performance standards that encouraged its workers to skip their breaks.

On top of the problem with meal and rest breaks, the lawsuit alleges that FedEx’s punch clock system allows an overtime issue.

According to the motion, management can use the punch clock system to “insert a recorded meal period at any time during an employee’s shift, without regard to whether or not the employee was actually working during that time according to defendant’s own records of package scan activity.”

The lawsuit over CA labor laws violations was filed in September 2017 in the U.S. District Court for the Central District of California.

The Fair Labor Standards Act (FLSA) protects workers at a federal level, and work laws in California get even more specific.

    Fedex is trying hard to arrest me to defend itsel, but my lawyer is amazed to see the amount of illegalities in the 2 lawsuits that they did not give me the right to defend myself, 10 years after my dismissal. They hid evidences by taking down my Yahoo email address and a blog dossier that I used to have. They insist that they did not find me despite my address appearing on at least 12 pages in the process.
    From the beginning, you have no idea what remains of bulling. So much so that it became a book. When the 727s were removed from operation here in Brazil and started to operate with an F27, it was not to transport dangerous goods but they were transporting, in addition, the cargo was arriving in Brazil from Argentina in a sorry way. I got tired of reporting, but my manager said it was Brazil and besides that he was black, he said he wouldn’t play it forward. It was until there was a fire in the cargo. The crew of Mountainair flew over Uruguay and were surprised by the smoke, luckily there was a runway nearby, they landed but it was a total loss of the aircraft.
    My ex manager, Fernando Ibere Dias wanted me to deliver a certain quantity of cocaine for him and I refused. The persecutions reached a level that I had to report, but I was fired because director Carlos Eduardo Ienne had been caught by police for possession of drugs for his own use in 2002. I was fired and they hired the drug dealer who would supply the drug. I sued Fedex, but they bought my lawyer, judges and a senator. Everything was confirmed by a delegate from São Paulo, everything was on my blog. Now they want to arrest me. I need help from America, because here Fedex pays bribes to the authorities and they’ve ruined my life enough.
