An Ohio family filed an asbestos cancer lawsuit against Honeywell International, alleging that the company allowed the mother to be exposed to harmful asbestos fibers. As a direct result of this exposure, the lawsuit claims, the plaintiff was diagnosed with cancer.
The plaintiff, Julia A., was diagnosed with mesothelioma and as a result has suffered from permanent injuries because of this asbestos-induced disease, as well as mental anguish and suffering, a shortened life span, impaired quality of life, and medical expenses.
According to the asbestos lawsuit, Honeywell knew or should have known that the asbestos fibers released from asbestos-containing products and materials could be “deleterious, poisonous, and highly harmful to Plaintiff’s health.” Despite knowing of the dangers of exposure to asbestos fibers, the defendants failed to warn those in proximity to asbestos-containing materials and products of the risks involved.
The asbestos lawsuit was filed on multiple counts, including negligence, strict liability, breach of express and implied warranties, punitive damages, conspiracy, as well as loss of consortium by her spouse.
The claim was filed not only against Honeywell International but also against other companies that manufactured, sold, or installed asbestos-containing products that allegedly led to Julia’s asbestos-related disease.
What is Asbestos?
Asbestos is a naturally occurring mineral used for commercial purposes such as electrical or building insulation, as well as countless other uses.
When a person is exposed to products or materials containing asbestos, microscopic asbestos fibers may be released into the air and can accumulate in the lungs and cause several critical health problems, including cancer.
Cancer from asbestos fibers is not always immediately diagnosed, and may in fact take decades to develop. However, mesothelioma can quickly spread, and cancer detected at a late stage of development is more dangerous and difficult to treat.
Asbestos Mesothelioma
Mesothelioma is a cancer that attacks the lining of the lungs, and has been primarily associated with exposure to asbestos fibers. Mesothelioma is a particularly dangerous kind of cancer, with a survival rate of about 40 percent after the first year past diagnosis. Mesothelioma survival rates really only improve with early detection rather than treatment options.
Asbestos Cancer Lawsuits
Most asbestos cancer lawsuits are linked with workers who have been exposed to large amounts of asbestos fibers over time. In these cases, asbestos fibers became airborne on a regular basis in their workplace and entered a worker’s lungs.
Exposure to asbestos fibers can lead to a lung cancer diagnosis, incurring physical, mental, and emotional pain and suffering, as well as quite substantial medical expenses.
According to many asbestos cancer lawsuits, the companies that allow their workers to be exposed to asbestos fibers should have been aware of the dangerous nature of their asbestos-containing materials. Companies should be aware of its ability to cause disease and even fatalities. There are many asbestos regulations in place to protect workers and prevent these kinds of issues.
Many people exposed to asbestos fibers — often construction, automotive and shipyard workers — have filed asbestos cancer lawsuits, seeking compensation for the injury and losses they’ve had to endure.
If you or someone you know was exposed to asbestos fibers — even many years ago — and has been diagnosed with an asbestos-related disease or died, you may be able to file an asbestos lawsuit.
The Asbestos Lawsuit is Case No. 1:17-cv-00504-DCN, in the Court of Common Pleas for Cuyahoga County, Ohio.
