NYU antisemitic lawsuit overview:

  • Who: New York University is facing a lawsuit from Plaintiffs Bella Ingber, Sabrina Maslavi and Saul Tawil, all NYU students who claim it has created a hostile environment that leads to antisemitism.
  • Why: NYU is accused of acting with indifference in response to antisemitism while refusing to enforce its anti-discrimination rules to prevent the abuse.
  • Where: The NYU lawsuit was filed in federal court in New York.

New York University is facing a lawsuit from three students claiming that it has created a hostile environment that leads to antisemitism on its campus.

Plaintiffs Sabrina Maslavi and Saul Tawil claim that NYU is aware of the antisemitism but refuses to enforce its anti-discrimination rules to stop the abuse.

The students say they are forced to deal with being abused, maligned, vilified and threatened with the abusers not facing punishment. The plaintiffs say they are faced with chants such as “Hitler was right,” “gas the Jews,” “death to kikes” and “from the river to the sea.”

“In enabling this campus antisemitism—which spews the same anti-Jewish vitriol the Nazis propagated 80 years ago—NYU has violated Title VI of the Civil Rights Act of 1964, breached its duties to plaintiffs and all other Jewish students it agreed to protect, and made plain that the representations and promises it made to plaintiffs on which they relied in enrolling at and paying tuition to NYU were false,” the NYU antisemitic lawsuit says.

Students can’t meaningfully participate in campus activities and are at risk for physical, emotional injuries, NYU lawsuit says

The students claim the NYU antisemitism has prevented them from fully being able to participate in campus activities and it has regularly put them at risk for extreme emotional and physical injury.

In a decision siding with New York University, a federal judge in early 2022 ruled that a former NYU graduate student cannot recoup tuition costs from spring 2020. The student failed to show that NYU promised in-person education in exchange for tuition, the judge said.

The plaintiffs are represented by Marc E. Kasowitz, Daniel R. Benson, Mark P. Ressler, Andrew L. Schwartz, Joshua E. Roberts, Jillian R. Roffer, Yarden Hodes and William Wolfe Taub of Kasowitz Benson Torres LLP.

The NYU antisemitic lawsuit is Ingber, et al. v. New York University, Case No. 1:23-cv-10023, in the U.S. District Court for the Southern District of New York.
