wage and hour overtimeAfter nearly two years, a Burberry unpaid overtime class action lawsuit has reached a settlement amount of $2.45 million, bringing an end to the allegations upon approval by federal court.

A settlement agreement does not indicate a company’s liability in a class action, so Burberry has not admitted any fault in this unpaid overtime class action lawsuit.

The plaintiffs, employees of New York Burberry retail stores, filed this Burberry unpaid overtime class action lawsuit back in December 2015.

According to the lawsuit, the retailer failed to pay proper overtime required under both the Fair Labor Standards Act (FLSA) and the state labor laws of New York. The Class is fairly expansive, including around 643 individual Class Members who are either current or former sales associates of Burberry stores.

“We’re pleased that we were able to reach an excellent settlement that will allow hundreds of retail workers to recover a substantial amount of money for their off the clock claims,” said one of the attorneys representing the employees in the Burberry unpaid overtime class action lawsuit, according to Law360.

A second proposed unpaid overtime class action lawsuit including those who work or have worked as shippers and receivers at New York Burberry stores has similar claims, and is included in this proposed settlement agreement.

Current and former Burberry employees included in the unpaid overtime class action lawsuit would receive no less than $150 from the settlement, lead plaintiffs noted. The 19 named plaintiffs would get an award totaling around $62,500 to be distributed among them.

The Burberry unpaid overtime class action lawsuit was filed in December 2015 in the U.S. District Court for the Southern District of New York.

Wage and Hour Regulations

There are a series of both federal and state wage and hour laws put in place to protect workers and ensure they are treated fairly.

However, many workers across the country do not know the protections that the Fair Labor Standards Act (FLSA) offers, which can lead to employers taking advantage of them, in some cases requiring unpaid overtime work despite the illegality of doing so.
