In-N-Out Discrimination Lawsuit Filed by Black, Older Applicants

In-N-Out discriminationA class action lawsuit filed last week accuses In-N-Out Burger of discriminating against black and older applicants by trying to keep them out of its “predominately” young and non-black workforce.

Oakland, Calif. Plaintiffs Alonzo Brown and Carlos Dubose – both African Americans over the age of 40 – allege in the In-N-Out Burger class action lawsuit that despite being qualified for jobs at the fast food chain, they were not hired due to their race and age.

Brown says he was denied a store associate position at In-N-Out in August despite “extensive years of experience.” Dubose says he was not hired for two jobs he applied for in July and August.

The In-N-Out employment discrimination lawsuit is seeking back pay and monetary relief for a proposed class of all individuals who were similarly discriminated against based on their race, color and age. It is also seeking an end to the alleged “systematic discriminatory hiring practices” at In-N-Out.

Attorneys representing the burger chain denied the accusation, saying the Plaintiffs “have no basis in fact” and that the restaurants where the Plaintiffs applied “each have a workforce that is over 23% African American.”

“In-N-Out Burger does not discriminate on the basis of ethnicity, race or age in its hiring policies or practices,” In-N-Out’s general counsel said in a statement. “We hire from our local communities and our restaurants reflect the demographics of that community. The company will aggressively defend itself against these irresponsible allegations.”

      It looks like the settlement was granted final approval in July 2017, and no appeals were filed, which is good news. It is not known how quickly claims will be paid.     I know this case settled…and I was a part of it, but I’ve never heard anything… and the websites have disappeared…..

    Did this case settle? I received an email about 6-7 months about a pending age discrimination suit that was going to settle but I deleted it by accident. Or is there a newer case you know about? I applied at In n Out in June 2015. Either way I never received a settlement check for the $2500.00 the email stated!!
