Speedway, Gender Bias & Class Action Lawsuit

Speedway Gender Bias Class Action Lawsuit Overview:

  • Why: The complaint accuses Speedway of paying its female general managers less than its male general managers under the same working conditions.
  • Who: Speedway female general managers are suing the convenience store and gas station company.
  • Where: The class action lawsuit was filed in Pennsylvania federal court.

A Pennsylvania federal judge certified a class action collective of Speedway female general managers who claim the convenience store company violated labor laws by routinely paying them less than their male counterparts. 

US District Judge Gerald McHugh found that the complaint sufficiently proved that in terms of the allegations, salaried Speedway general managers are similarly situated “both by having similar duties and responsibilities across Speedway stores and by being subject to a common compensation policy.”

The class action lawsuit will include all female employees who are or have been employed by Speedway as salaried general managers from 2017 to the present, according to court records.

The main plaintiff on the complaint is Nancy De Block, who worked as a salaried general manager for Speedway until July 2017. When she was hired, De Block says she was paid $15,000 less than a male general manager who performed the same job and whom De Block had to mentor since he had less retail experience.

The initial class action lawsuit filed in February 2020 was filed by De Block and former Speedway general managers Susan Ludwig and Sheila Carrasquillo, who were dismissed from the case for being unresponsive. 

Speedway Claims Compensation Based on ‘Individual Circumstances,’ While Female General Managers Are Routinely Paid Less Than Male Counterparts, Class Action Alleges

Speedway filed an opposing motion in August, arguing that De Block failed to prove the company’s policies that resulted in underpayment of its female employees were illegal.

However, Judge McHugh ruled that Speedway’s argument was out of turn, being irrelevant to the question of class certification. 

Speedway had also claimed that their general managers’ compensation is based on individual circumstances, including experience level, sales performance, and market differences in pay rates. Judge McHugh rejected this argument, ruling that such evidence can be explored in later stages of the class action lawsuit.
