Current and former MedMen workers may be able to claim as much as $414 under a new $975,000 class action settlement over claims that the marijuana company violated California labor laws.
MedMen workers filed the lawsuit against the marijuana company in 2018 alleging that they were not paid a minimum wage for “off the clock” work nor were they provided mandatory meal and rest breaks. The class action lawsuit claims that MedMen also failed to pay overtime and failed to keep accurate records of employees’ hours.
The company and its workers were able to reach an agreement last week. If approved by a California judge, the settlement will reportedly cover about 1,300 current and former MedMen employees who worked at California locations between November of 2014 and September of 2020.
In addition to the Class Member awards, the nearly $1 million MedMen settlement will cover $325,000 in lawyer fees, $75,000 to settle penalties, $15,000 for settlement administration, and $11,000 in court fees.
When the MedMen marijuana class action lawsuit was first filed, legal experts warned that it could spell serious problems for the company.
The lawyer representing the lead plaintiffs in the lawsuit reportedly accused MedMen of “wage theft” and said the multi-state company “intentionally failed” to pay workers under California labor law.
“Class actions are very serious to deal with, and if the class gets certified, it’s a real problem for the employer,” San Francisco attorney Katy Young told Marijuana Business Daily at the time. “Wage and hour issues are very serious as there are penalties. Not only are there liabilities for what you didn’t pay, sometimes there are treble damages.”
