A California man is suing J. Crew alleging the company illegally wiretapped his actions online, tracking his clicks from an email newsletter.
Plaintiff Marcelo Muto filed the class action lawsuit against J. Crew Group LLC on Aug. 22 in a New York federal court, alleging violations of state and federal consumer laws.
According to the lawsuit, J.Crew enabled the wiretapping of electronic communications between itself and its clients via emails sent from [email protected], without the knowledge or consent of recipients.
Muto alleges the company contracts with a third party, Bluecore Inc. to provide the software that runs on the emails and the corresponding web pages that those recipients are routed to after clicking on the links.
“The electronic communications of users of the Emails and Website are routed through the servers of and are used by Bluecore to, among other things, secretly observe and record the interactions of Defendant’s customers when they open and/or click on the Content of the Emails and the landing pages of Defendant’s Website in real-time,” the lawsuit states.
Company tracked clicks to website, lawsuit alleges
Muto alleges he received and interacted with J. Crew emails on multiple occasions from his computer while in California. He alleges that, in Jan. 2023, he opened a J. Crew email in which Bluecore intercepted, in real-time, his engagement with the email’s content.
Muto says, upon clicking the email content, Bluecore continued to intercept his communications throughout the web pages he was directed to on the J. Crew website.
“Mr. Muto was unaware at the time that his engagement with the Emails, the Website, and other electronic communications were being intercepted in real-time by Bluecore, nor did Mr. Muto consent to the same,” the lawsuit alleges.
He seeks to represent anyone who received J. Crew’s emails and whose electronic communications were intercepted or recorded by Bluecore. Muto is suing for violations of the California Invasion of Privacy Act, California business laws and statutory larceny.
He seeks certification of the class action, damages, fees, costs and a jury trial.
In April, J.Crew was hit with a class action lawsuit alleging it falsely advertises its J.Crew clothing line as comparable to its J.Crew Factory line when promoting “comparable value” prices at its retail locations or online store.
