Barry University Tuition Refund Class Action Lawsuit Overview:

Barry University has agreed to pay $2.4 million to settle a class action lawsuit filed against the university alleging it refused to refund students for tuition and other fees after it closed its campus during the COVID-19 pandemic.
Plaintiff Marlena Rosado claimed Barry denied students refunds despite moving all its classes online and closing its housing, dining, and campus services during the spring 2020 semester.
A total of more than 6,000 Class Members will receive around 60 percent of their projected recoverable damages in exchange for releasing all claims against the university, according to the settlement agreement.
US District Judge Jose E. Martinez said the settlement was an “excellent,” result given the circumstances behind the class action lawsuit.
“The Settlement is fair, adequate, and reasonable, and an acceptable compromise of the Settlement Class Members’ claims,” Martinez wrote.
Barry will now have 15 days to put the $2.4 million into a common fund for Class Members who were either enrolled in the school during the Class period or who paid on a student’s behalf.
Fla Students To Get Portion of Barry University Tuition Back for COVID Term
Class Members can choose to receive their portions of the settlement in cash payments, tuition credit, or a credit for unpaid balances still owed to Barry, according to the settlement agreement.
The court granted preliminary approval of the settlement back on March 30, after previously denying Barry’s motion to dismiss an amended version of the class action lawsuit.
Barry had argued that Rosado failed to properly state a claim for unjust enrichment or state a breach of contract claim, among other things.
The class action settlement was finally reached after about a month’s worth of mediation, according to the order.
A similar class action lawsuit was filed last month by University of Florida students who allege the school should reimburse them for having to transition to virtual learning because of COVID-19 restrictions.
