Amplify Energy Oil Spill Class Action Lawsuit Overview: 

  • Who: Amplify Energy Corporation, Beta Operating Company, LLC, and others are facing litigation in the wake of a major oil spill. 
  • What: The plaintiff owns an events company that operates on now-closed Huntington beach and says the energy companies are responsible for the oil spill.
  • Where: The class action lawsuit was lodged on behalf of businesses and residents affected by the spill.

A California DJ is the first to launch a class action lawsuit against Amplify Energy after the company’s oil rig suffered a breach that sent at least 126,000 gallons of oil spilling into California’s Pacific coast on Friday.

Plaintiff Peter Moses Gutierrez Jr. filed the class action against Amplify Energy Corporation, Beta Operating Company, LLC and unnamed others in a California federal court Monday, seeking damages for lost work and potential health impacts. 

The defendants operate an oil rig and connected pipelines located off the coast of the state of California. Last Friday, the rig — Elly — suffered a breach. The complaint says, at the time of the filing, at least 126,000 gallons of oil were spilled into the Pacific Ocean, causing an “environmental catastrophe.”

“At the time of this complaint’s filing, deceased animals were washing up covered in oil on the shoreline of the affected area and a large ecological reserve nearby had suffered tremendous damage,” the lawsuit states. 

“Additionally, the Orange County healthcare agency released a statement to the citizens of the affected area about the deleterious effects of the oil spill to human health and safety.”

The class action seeks to represent any person or business that was harmed as a result of the spill.

In Gutierrez Jr.’s case, his harm is two-fold, the lawsuit claims. He says he owns a DJ company which performs events frequently on the Huntington Beach beachfront, and that he is losing a substantial amount of his business for the foreseeable future due to the necessary closure of Huntington Beach.

Huntington Beach Mayor Kim Carr has said the disaster was so profound that it warranted closing the beaches in Orange County for up to “a few months,” the lawsuit states.

As a resident of Huntington Beach, Gutierrez Jr. also says he will be exposed to toxins as a result of the defendants’ conduct. 

He says, after the spill, Orange County healthcare agency released a notice recommending those who may have encountered contaminated materials seek medical attention. 

“The effects of oil spills on humans may be direct and indirect, depending on the type of contact with the oil spill,” the agency warned.

Gutierrez Jr. is suing for negligence and private nuisance The class action lawsuit seeks damages under environmental laws and damages to pay for medical monitoring.

Gutierrez Jr. is also asking for certification of the class action, interest, an injunction, a judgement that the defendants are responsible for remedying the situation, attorneys fees and costs. 

In February, the San Francisco Herring Association filed a class action lawsuit claiming a 750 gallon Chevron oil spill will devastate the industry for years to come.
