Vision Solar systems class action lawsuit overview:

  • Who: A group of 22 solar consumers are suing Vision Solar.
  • Why: The plaintiffs say the company falsely advertised their solar systems.
  • Where: The Vision Solar systems class action lawsuit was filed ina New Jersey federal court.

Vision Solar preyed on vulnerable populations to sell a solar system that did not work as promised, a new class action lawsuit alleges.

A group of 22 plaintiffs filed the class action lawsuit against Vision Solar LLC on April 10 in a New Jersey federal court, alleging violations of state and federal consumer laws.

According to the lawsuit, Vision Solar fraudulently induced homeowners in Arizona, Connecticut, Florida, Massachusetts, New Jersey, and Pennsylvania to enter into agreements to purchase residential solar photovoltaic systems.

“Vision Solar deliberately targeted vulnerable populations—including low-income, disabled, and elderly individuals—and induced them into the purchase or lease of Solar Panel Systems by systematically misrepresenting the benefits of Solar Panel Systems, including homeowners’ eligibility for tax credits, the performance of the Solar Panel Systems, and the financial terms of the loans and leasing transactions,” the lawsuit states.

The plaintiffs say the alleged tactics have been described by the Connecticut Attorney General as “the worst [the office] has seen.”

Vision Solar’s complete failure to perform as promised has left thousands of defrauded customers paying for Solar Panel Systems that are either not working at all because they are not hooked up to the power grid, or performing so far below the levels promised by Vision Solar, that they are losing money on a net basis, they add.

Hundreds of complaints filed, lawsuit states

So far, hundreds of complaints have been filed with the attorneys general of the states in which Vision Solar and its financing partners operate, the lawsuit states.

Vision Solar’s deception regarding material and foundational aspects of the sales and financing agreements for the Solar Panel Systems render each and every agreement void, the plaintiffs say.

They say they would never have entered into agreements with Vision Solar absent the company’s “lies” which allegedly saw products that don’t work sold via unfair means.

As a result, the plaintiffs seek to represent all homeowners in Arizona, Connecticut, Florida, Massachusetts, New Jersey, and Pennsylvania who purchased Solar Panel Systems from Vision Solar and entered into agreements with Financing Companies.

They are suing for fraudulent inducement, unjust enrichment and violations of state consumer law. The plaintiffs seek certification of the class action, restitution, disgorgement of profits, recission of the sales and financing agreements, and damages.

Meanwhile, Tesla is fighting class action claims that it has been unfairly hiking up the price of its solar roof tile system.

    2. Carliss wileman cline says:

I am in Texas but I need to join class action lawsuit with others.vision Solar lies about everything to make a sale. He said Zero electric bill, 30 percent rebate , 18kw, cancel electric company, 50 panels that are improperly engineered . Way too many just to make money. I am 74 and they charged me $89,616.00 for 25 years. I never signed a contract with Dividend Financial knowingly. It was underhanded. Everyone has the same story , we all can’t be wrong like Vision Solar want us to think. It’s been a nightmare for all.

  9. Angeline M Schilling and Raymond H. Schilling says:

We are customers of Solar but, feel that we were lied to by the salesperson. The Income tax refund was not as he explained it to us, we had trees in our yard that blocked the sun from the panels, and he lied saying they would not effect it. Our neighbor is a representative for a different Solar Co and he wouldn’t approach us about a system because of the trees, out ages and disabilities. IF WE HAD ONLY CONFIDED IN HIM FIRST!

  10. Louis Vaughn says:

Same. Panels installed and not working. 3 months and counting no information on when the panels will work. Still waiting for them to pay my monthly finance bill. Not to mention the interest on the loan.

    1. Rose Lee says:

Took me 8 months and they did not reimburse me for the payments they promised. I been waiting 34 months. Didn’t qualify for gov money it is tax rebate I owe no taxes.
