Fish oil supplements class action lawsuit overview:ย

  • Who: Dayna Clark filed a class action lawsuit against Nordic Naturals Inc.ย
  • Why: Clark alleges Nordic Naturals misleadingly claims that the fish oil supplements it sells benefit heart health.ย
  • Where: The class action lawsuit was filed in California federal court.

Nordic Naturals misleadingly represents that its fish oil supplements support heart health, a new class action lawsuit alleges.ย

Plaintiff Dayna Clarkโ€™s class action lawsuit claims studies on fish oil supplements like those sold by Nordic Naturals have shown they can be harmful to heart health and are a waste of money for consumers.

โ€œMs. Clark read and relied on this statement that the Product promotes heart health and would not have purchased the Product if she had known that the Product does not promoteโ€”and can even harmโ€”heart health,โ€ the Nordic Naturals class action says.ย

Clark is seeking to represent a nationwide class, California subclass and consumer protection subclass involving multiple states of all persons who have purchased one or more Nordic Naturals Fish Oil Capsules.ย

Studies show fish oil supplements no better than placebo, class action claims

Clark argues studies have shown there is no evidence fish oil supplements improve a personโ€™s cardiovascular health, offer nothing more than a placebo would and are actually harmful to heart health.ย

โ€œBy selling Products that purport to support heart health, Nordic Naturals is representing to customers that taking its fish oil capsule is beneficial to heart health,โ€ the Nordic Naturals class action argues.ย

Clark claims Nordic Naturals is guilty of intentional misrepresentation and omission, negligent misrepresentation and omission, breach of express warranty and quasi contract, and violating consumer protection acts from multiple statesย

The plaintiff demands a jury trial and requests injunctive relief along with an award of treble and punitive damages for herself and all class members.ย

A consumer filed a similar class action lawsuit against Nestlรฉ Health Sciences U.S. LLC and its brand Natureโ€™s Bounty earlier this year over claims the company falsely advertises its Natureโ€™s Bounty fish oil supplements as being beneficial for cardiovascular health.ย
