A new class action lawsuit accuses Naked Whey of falsely advertising its Naked Nutrition vegan protein powder products.
Plaintiff Carol Valenta filed the class action complaint against Naked Whey on June 17 in California federal court, alleging violations of state and federal consumer laws.
Valenta’s lawsuit alleges Naked Nutrition’s vegan protein powder products are misbranded and falsely advertised because they feature deceptive protein claims on the label.
Naked Nutrition’s vegan protein powder products include Naked Pea, Naked PB, Naked Mass, Naked Shake, Naked Rice, Naked Almond and Naked Seed, the lawsuit says.
Valenta claims the company misrepresents the percent of the recommended daily value of protein contained in each serving of its vegan protein powder products.
She argues that Naked Nutrition’s labels mislead consumers by not accurately reflecting the protein quality and digestibility of the vegan protein powder products, which use plant-based proteins with lower protein digestibility corrected amino acid scores compared to animal-based proteins.
Lawsuit: Naked Nutrition protein powder labels mislead consumers
The lawsuit claims that Naked Nutrition’s labels give the impression that the protein content in the vegan protein powder products is fully digestible and of high quality, when that is actually not the case.
Valenta argues that this misrepresentation is significant for consumers who rely on accurate protein information to meet their dietary and fitness goals.
The plaintiff claims she purchased Naked Nutrition’s Naked Pea protein powder multiple times, believing the product contained the advertised amount of protein.
She argues that she and other consumers were misled into paying a premium for the vegan protein powder products based on the false protein claims.
Valenta wants to represent anyone in California who purchased Naked Nutrition’s vegan protein powder products in the past four years. She is demanding a jury trial and requesting declaratory and injunctive relief and an award of actual, compensatory or statutory damages for herself and all class members.
Similarly, a consumer filed a class action lawsuit against vegan meal and supplement company Huel Ltd., alleging it misrepresented the amount of protein in its Black Edition Vegan Protein Powder.
