The question as to whether Rainbow Light Prenatal One vitamins are safe stems from independent lab testing of the supplements done by request of the Los Angeles City Attorney’s Office.
According to an Aug. 14, 2019 report posted by Courthouse News.com, Rainbow Light Nutritional Systems LLC, as well as Nutrinext LLC and related companies, were suspected of using misleading advertising to sell Rainbow Light Prenatal One vitamins to consumers by claiming they were ‘free of heavy metals’.
The Los Angeles City Attorney’s Office reportedly employed a third-party lab to test claims that Rainbow Light Prenatal One vitamins had lead levels that were the lowest in the commercial marketplace capable of being detected. The results of the testing revealed trace amounts of lead in the prenatal supplements.
What Is A Safe Amount of Lead?
According to California law Proposition 65, lead is a concern because its ingestion can cause birth defects and other reproductive damage as well as increase the risk of developing cancer. Typically associated with paint and other construction materials, consumers can be unwittingly exposed to lead through many consumer products such as imported pottery, cosmetics, imitation leather products, hair dyes, lead-acid batteries, and dietary supplements.
As indicated by Los Angeles City Attorney Mike Feuer’s website, the standard of safety set by Proposition 65 is based on data over four decades old; the intake of lead over .5 micrograms a day, according to research, is dangerous. This intake level is considered a general guideline and irrespective of a state of pregnancy. Under Proposition 65, California businesses are required to alert consumers if their products contain or expose them to a greater amount.
In fact, current scientific understanding is a bit more stringent in terms of lead intake. As indicated by the City Attorney’s website, state regulators are considering and hoping to make a shift in the Proposition and lower acceptable intake to .2 micrograms per day. When the Rainbow Light vitamins were first tested by the third-party, the results came back higher than .2 micrograms.
What Was The Outcome Of The City Attorney Office Testing?
According to Fox 5 San Diego.com on Aug. 14, Los Angeles City Attorney Mike Feuer’s Office was able to reach a $1.75 million settlement with Rainbow Light Nutritional Systems and related companies. The settlement brings with it numerous requirements allowing for product accountability.
First, the Rainbow Light settlement provides for an injunction against the kind of advertising at issue. Claims of ‘lowest detectable amount of lead’ in terms of commercial vitamins must be immediately dropped and replaced with a rigorous commitment to outside testing and reporting to the City Attorney’s Office.
Rainbow Light, owned by the Clorox Co., must submit to testing every six months to ensure levels do not exceed .2 micrograms daily. If it does, a report must be issued to the City Attorney’s Office and an internal investigation initiated. It is expected that a follow-up report will be sent within 45 days.
The $1.75 million dollar settlement reportedly includes $1.5 million in restitution money for purchasers of the product over the last four years. It also includes $250,000 in civil penalties and costs.
