Sports Research Corporation has agreed to a settlement to resolve claims that its Premium MCT Oil products and Turmeric Curcumin C3 Complex products were labeled in a deceptive manner. The settlement provides $3 cash payments or $7 product vouchers to consumers who purchased these items.

The settlement benefits individuals who purchased Sports Research MCT Oil liquid dietary supplement beverage additive and/or Turmeric Curcumin C3 softgel products between Jan. 9, 2016 and Jan. 9, 2020.

Sports Research’s MCT Oil and Turmeric Curcumin C3 were reportedly labeled as “packed with beneficial fats” and capable of sustaining “natural” energy. Additionally, the MCT products were allegedly marketed as antibacterial, anti-microbial and having anti-viral properties. Similarly, plaintiffs said that the turmeric product was labeled as anti-inflammatory and able to provide antioxidant benefits.

These claims reportedly enticed consumers such as the plaintiffs to purchase the products for a premium price. Unfortunately, the products were allegedly labeled in a deceptive way.

The plaintiffs noted that the MCT product contains 14 grams of saturated fat – putting it above the threshold for a “healthy” product. The Sports Research class action lawsuit also noted that, while the products were marketed as providing “natural” energy, they use raw coconut materials which undergo a “heavy and lengthy” process in order to become MCT oil. As such, the plaintiffs maintained that the products could not be considered natural.

The Sports Research class action lawsuit included similar arguments against the other marketing claims found on the MCT Oil and turmeric product labeling.

Although these labeling claims were reportedly false, plaintiffs argued that Sports Research chose to market their products in a deceptive way in order to convince consumers to purchase the MCT Oil and turmeric products.

“As a consequence of Defendant’s unfair and deceptive practices, Plaintiffs and other consumers similarly situated purchased the Products under the false impression that by consuming these Products, they would be enjoying the healthful and nutritional benefits associated with the Products as advertised,” the Sports Research class action lawsuit contended.

“Had Plaintiffs and other consumers similarly situated been made aware that the advertised benefits of the Products were false, they would not have purchased the Products, would have paid less for them, or purchased a different nutritional supplement altogether.”

Sports Research has not admitted any wrongdoing but has agreed to resolve the claims against them in a settlement deal.

Under the terms of the settlement, Class Members can choose between two forms of compensation: a $7 voucher able to be used towards any Sports Research product or a $3 cash payment.

The voucher is valid for one year and freely transferrable. These vouchers can be used towards any product sold or manufactured by Sports Research Corporation. The cash payment option is smaller, providing only $3.

In order to benefit from the Sports Research false ad class action settlement, Class Members must file a valid claim form by Feb. 23, 2021. No proof of purchase is required to benefit from the settlement. However, if Class Members wish to collect a cash payment they must swear under penalty of perjury that they purchased the products.

The deadline for exclusion and objection is Feb. 23, 2021. The final approval hearing for the Sports Research settlement is March 26, 2021.
