Surfshark deceptively enrolls “unwary” consumers in an auto-renewal payment plan for the cybersecurity company’s products and services, a newly amended class action lawsuit alleges.
Plaintiff Emily Pachoud’s amended class action lawsuit claims Surfshark lures consumers and traps them into an automatic renewal plan without disclosing “essential facts” about the nature of the payment, as required by California law.
“Plaintiff and other consumers have been deceived by Defendant’s actions, and consequently have been deceived into signing up for an automatically recurring payment plan,” the Surfshark class action says.
Pachoud wants to represent a California class of consumers who were automatically enrolled in Surfshark products and were charged at least one renewal fee by the company within the governing statute of limitations period.
Surfshark fails to get affirmative consent from consumers prior to auto-renewing them, class action claims
Pachoud argues Surfshark fails to obtain affirmative consent from consumers prior to charging them and does not clearly outline the renewal offer terms on its website.
“A consumer can easily use the website and complete their purchase without viewing these terms, meaning Defendant does not satisfy the requirement for close proximity under the (law),” the Surfshark class action says.
Pachoud claims that Surfshark is guilty of quasi contract and unjust enrichment and in violation of California’s False Advertising Law, Unfair Competition Law and Consumers Legal Remedies Act.
She demands a jury trial and requests declaratory and injunctive relief and an award of all economic, monetary, actual, consequential, compensatory, treble and punitive damages for herself and all class members.
A pair of consumers filed a similar class action lawsuit against Paramount Global late last year over claims the entertainment company continued charging consumers who already canceled their Paramount+ streaming service subscriptions.
