Hyundai oil pump defect class action lawsuit overview:ย

Hyundai Motor America sold certain vehicles containing malfunctioning oil pumps that pose a โ€œmassive fire risk,โ€ a new class action lawsuit alleges.ย 

Plaintiff John Franz claims Hyundai and its subsidiary Kia issued a recall last month over the alleged oil pump defect that included more than 90,000 vehicles produced by either of the two automakers.ย 

Franz argues the oil pumps in the recalled Hyundai and Kia vehicles contain a controller that can short-circuit and overheat, causing the oil to likely โ€œoverheat and combust.โ€ย 

โ€œDue to the design defect, the Class Vehiclesโ€™ oil pump tends to malfunction and overheat while surrounded by combustible oil. This is a massive fire risk,โ€ the Hyundai class action states.ย 

The class vehicles are model year 2023-2024 Hyundai Palisade, 2023 Hyundai Tucson, 2023 Hyundai Sonata, 2023 Hyundai Elantra and 2023 Hyundai Kona vehicles, according to the class action.ย 

Franz wants to represent a nationwide class and South Carolina subclass of consumers who purchased or leased any of the class vehicles.ย 

Hyundai concealed, failed to disclose oil pump defect, class action says

Franz argues Hyundai concealed and failed to disclose to its customers that the class vehicles allegedly contained a defective oil pump.ย 

โ€œ(Hyundai) knew that the Class Vehicles suffered from an inherently defective oil-circulation system, were defectively designed and/or manufactured, and were not suitable for their intended use,โ€ the Hyundai class action states.ย 

Franz claims Hyundai is guilty of negligence, unjust enrichment, fraud by omission or fraudulent concealment, negligent design defect, breach of implied warranty of merchantability and breach of express warranty, and of violating the Magnuson-Moss Warranty Act.ย 

The plaintiff is demanding a jury trial and requesting declaratory relief along with an award of actual, general, special, incidental, statutory and consequential damages for himself and all class members.ย 

A separate class action lawsuit was filed against Hyundai in April 2022 over claims a number of Hyundai and Kia vehicles are equipped with defective engines that use an excessive amount of oil, stall and fail in time.ย

    Leased a 2023 Hyundai Tucson. Last summer it would not accelerate and had zero power, I almost got rear-ended by a semi. Had it towed to the dealership, said they could not find nada after keeping it for one week. I filed with the NTSB to note this issue. There are no recalls, yet I have seen other owners/lesses have had issues as well.

    I purchased a 2018 Hyundai Sante Fe Sport and have and it started having oil consumption issues. It is burning a lot of oil, and have already had to be towed to the dealer because it was bucking and could not be driven. All the dealer can say is that they are aware of the issue, there is no recall, and I have to pay out of pocket for the oil consumption test which costs approx $900 plus tax. I also have to pay out of pocket for a rental as they will not give me a loaner car even though I have the extended warranty. This is crazy! If they are aware of the problem, then they should fix it without me being out lots of money and problems. I hope someone can help me.

    I have taken my car into the dealership several times since the oil was low. They did the oil consumption test. The oil has been burning for the last year and a half. Now I need a new engine.

    I pu based a 2018 Hyundai Santa Fe Sport and it consumes a huge amount of oil! I have a log and have to fill with 2 quarts about every 200-300 miles. The dealer said this seems to be an issue and they are aware of it. Are there any class actions re oil consumption?? If not there should be

    Is the 2015 hyundai genesis a part of this? I have some issues not sure really what it is but my vehicle stall really bad once it gets within 300-500 miles near the oil change due miles marker point. It stalled and stinks at times.

    We just bought a 2023 Tucson Hybrid Plug-in It touted 80mpg with electric and 35 non-electric. Iโ€™m lucky to get 48 and 23 mpg. Also the thing takes 3 days to charge the battery if youโ€™re at home. We also noticed that the shifting doesnโ€™t work if itโ€™s cold.

    Weโ€™ve had nothing but problems with our Sonata. Still making car payments on a piece of junk! We have to keep large quantities of oil on the car and it can barely be driven around town.

    My son purchased a used Hyundai from a dealer ship and the engine light come on and it has no power to it. It also leads oil like crazy. What do they do? Theyโ€™re out of 4,000.00 for a piece of crap car that Hyundai denies that that modle has problems. Please contact me or leave me a reply of who and what he can do.
