Hyundai Motor America sold certain vehicles containing malfunctioning oil pumps that pose a โmassive fire risk,โ a new class action lawsuit alleges.ย
Plaintiff John Franz claims Hyundai and its subsidiary Kia issued a recall last month over the alleged oil pump defect that included more than 90,000 vehicles produced by either of the two automakers.ย
Franz argues the oil pumps in the recalled Hyundai and Kia vehicles contain a controller that can short-circuit and overheat, causing the oil to likely โoverheat and combust.โย
โDue to the design defect, the Class Vehiclesโ oil pump tends to malfunction and overheat while surrounded by combustible oil. This is a massive fire risk,โ the Hyundai class action states.ย
The class vehicles are model year 2023-2024 Hyundai Palisade, 2023 Hyundai Tucson, 2023 Hyundai Sonata, 2023 Hyundai Elantra and 2023 Hyundai Kona vehicles, according to the class action.ย
Franz wants to represent a nationwide class and South Carolina subclass of consumers who purchased or leased any of the class vehicles.ย
Hyundai concealed, failed to disclose oil pump defect, class action says
Franz argues Hyundai concealed and failed to disclose to its customers that the class vehicles allegedly contained a defective oil pump.ย
โ(Hyundai) knew that the Class Vehicles suffered from an inherently defective oil-circulation system, were defectively designed and/or manufactured, and were not suitable for their intended use,โ the Hyundai class action states.ย
Franz claims Hyundai is guilty of negligence, unjust enrichment, fraud by omission or fraudulent concealment, negligent design defect, breach of implied warranty of merchantability and breach of express warranty, and of violating the Magnuson-Moss Warranty Act.ย
The plaintiff is demanding a jury trial and requesting declaratory relief along with an award of actual, general, special, incidental, statutory and consequential damages for himself and all class members.ย
A separate class action lawsuit was filed against Hyundai in April 2022 over claims a number of Hyundai and Kia vehicles are equipped with defective engines that use an excessive amount of oil, stall and fail in time.ย

2019 Hyundai accent excessive oil consumption. Hyundai had it towed there had to pay out of pocket to replace two cylinders. Still uses too much oil adding 1-2q a week. Still the same problem after taking it to Hyundai. The other repair shop before Hyundai stated we need a new engine. Several thousands of dollars later same problems .
Yes. I have a Hyundai 2013 Sonata, the engine failed. Driving on the highway the car turned off which almost led to an accident. Everything that was labeled in the recall is what happened to our car. We had to have it towed to hyundai at our expense, and the car has been there for almost 1 month.
Our 2017 Santa Fe has been in the Hyundai Danbury, CT dealership service center for over two months. The engine seized due to no oil on a trip from our home on Long Island and was towed from I-84 to the dealership on July 7th, 2023. We can never reach anyone at the service desk or the dealership for that matter. The service manager Vince (who is no longer employed there), finally called us over a month ago to let us know that the engine would be replaced by Hyundai. As of today, our car has not been worked on, with no timetable for the replacement. No loaner cars are available there either.
Yes i live in florida and have had my 2023 elantra got it in January and it goes in comes out and goes back in for an engine over heat low oil and its been in 5 times for the same issues the car told me danger turn off engine overheat and i also only have 3000 miles on it
