Chicco Booster Seats Not Safe for Small Children, Says Class Action

Chicco Booster Seats Class Action Lawsuit Overview:

Artsana USA, Inc. makes, markets, and distributes Chicco-brand booster seats and falsely claims that they are safe for children as light as 30 pounds, a new class action lawsuit alleges.

Plaintiff Amanda Jimenez, a New York resident, claims there is a consensus among experts that booster seats are not safe for children under 40 pounds, and that Artsana is marketing theirs as safe in an attempt to compete with other manufacturers in the industry. 

Jimenez wants to represent a nationwide and New York Class of consumers who purchased a Chicco-brand booster seat marketed as safe for children as small as 30 pounds. 

Indeed, Jimenez says she purchased Chicco’s KidFit 2-in-1 booster seat in 2017 while relying on its claim that it was side-impact tested and safe for children who weigh as light as 30 pounds. 

Regulators Warn Against Chicco, Booster Seats for Young Children

The National Highway Traffic Safety Administration has warned against children under 40 pounds using a booster seat and has produced research showing there is a 27 percent increased risk of moderate or fatal injury for 3-to-4-year-olds who use a booster seat instead of a fully-harnessed seat, according to the class action lawsuit. 

Further, a 2020 investigation of the seven leading booster seat manufacturers by the US House of Representatives Subcommittee on Economic and Consumer Policy found Artsana “endangered the lives of millions of American children and misled consumers about the safety of booster seats,” according to the class action lawsuit. 

Jimenez claims Artsana is also misleading consumers by claiming its Chicco booster seats have enhanced side-impact protection, since the congressional report found there was no evidence to substantiate those assertions.  

Despite the congressional report’s findings, Artsana continued to market Chicco booster seats as safe for children as small as 30 pounds, the class action lawsuit alleges. 

“Defendant ignored the prevailing safety knowledge and put profit over safety, making deceptive recommendations that mislead consumers into thinking its Products are safe for children as light as 30 pounds,” states the Chicco class action lawsuit. 

Jimenez claims Artsana is in violation of New York General Business Law in regard to deceptive acts or practices and false advertising, in addition to being guilty of fraud, unjust enrichment, breach of the implied warranty of merchantability, and breach of express warranty. 

Plaintiff is demanding a jury trial and requesting compensatory, statutory, and punitive damages for herself and all Class Members. 

A similar class action lawsuit was filed in recent months by parents who say they relied on false information about the safety of Chicco booster seats. Competitor Graco faces a class action lawsuit lodged by consumers alleging the company falsely marketed its booster seats as being safe for children as light as 30 pounds.
