Conagra Brands Inc. is facing a class action lawsuit following its recent Banquet chicken strip recall of products that allegedly contain dangerous plastic.
The nationwide Banquet chicken strip recall was announced on Sept. 2 after the U.S. Department of Agriculture (USDA) Food Safety and Inspection Service notified Conagra about a consumer complaint of plastic in the chicken. One injury related to the plastic contamination was reported to the USDA at the time of the recall.
More than 245,000 pounds of frozen chicken entrees were reportedly affected by the Banquet chicken strip recall.
Conagra ‘unjustly enriched’ following Banquet chicken strip recall, plaintiff argues
Plaintiff Michael O’Sullivan filed the Banquet class action lawsuit on Sept. 11, claiming he purchased Banquet Brand Frozen Chicken Strips and believed they were safe to eat.
The Banquet class action lawsuit alleges Conagra’s Banquet chicken strip recall was inadequate because not all affected consumers will be aware of the recall. Further, the recall instructs consumers who purchased the recalled chicken strips to discard the product, but does not offer a refund option.
O’Sullivan claims that Conagra “has been and continues to be unjustly enriched” even after it sold food products with dangerous plastic. He filed the Banquet class action lawsuit on behalf of himself and other consumers who purchased the recalled chicken products.
The Banquet class action lawsuit notes that swallowing plastic can cause dangerous health effects, including oropharyngeal lodging and tearing, which can lead to asphyxiation or ultimately cause internal bleeding within the upper or lower gastrointestinal tract. Ingesting plastic can also result in the absorption of dangerous chemicals that may cause cell damage and hormone disruption.
Had he known that the Banquet chicken strips may have contained dangerous plastic, O’Sullivan says he would not have purchased the product.
